TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated May 9, 2005, and duly recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Book No. 3242, at Page 190, Bridget Denise Davis did convey unto Carl H. Cather, III, Esq., Spilman, Thomas & Battle, PLLC, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by Ajax Mortgage Loan Trust 2020-D, Mortgage-Backed Securities, Series 2020-D, by U.S. Bank National Association, as Indenture Trustee to foreclose thereunder, will offer for sale at public auction at the front door of the Kanawha County Courthouse in Charleston, West Virginia, on October 26, 2021 at 11:00 AM the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in CHAS SA District, Kanawha County, West Virginia, and more particularly described as follows: All that certain lot, tract of parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in the City of Charleston, Kanawha County, West Virginia, being parts of Lots Four (4) and Five (5) of the subdivision of Jenny Louhoff lands as shown upon a map of said lands of record in the Office of the Clerk of the County Commission of Kanawha County in Map Book 4, at page 149, and more particularly bounded and described as follows: BEGINNING on the southerly side of Louden Heights Road at the common corner of Lots 5 and 6; thence with the southerly line of said Road, N. 57 09′ E. 40 feet to an iron pipe at the common front corner of Lots 4 and 5; thence continuing with the southerly line of Louden Heights Road, N. 59 07′ E. 7.5 feet to an iron pin; thence through Lot 4, S. 26 33′ E. 110.3 feet to an iron pipe at the foot of a cherry tree; thence through Lot 5, S. 21 35′ W. 42.2 feet to an iron pin 10 feet in an easterly direction from the common line of Lots 5 and 6; thence with a line parallel to and 10 feet from said common line S. 29 00′ E. 62.2 feet to an iron pin in the southerly line of Lot 5 and northwesterly line of a 16 foot road; thence with said road, S. 22 43′ W. 12.7 feet to an iron pipe in the common corner of Lots 5 and 6; thence with the common line of Lots 5 and 6, N. 29 06′ W. 204.4 feet to the place of beginning; and being all of the same property conveyed unto the parties of the first part herein by Richard J. Kolb and Louise Kolb, his wife, by deed dated July 21, 1989, and recorded in the aforesaid Clerk’s office in Deed Book 2229, at page 943; to which map and deed reference is here made for a more particular description of the property herein conveyed. At the time of the execution of the Deed of Trust, this property was reported to have an address of: 1557 Loudon Heights, Charleston, WV 25314. The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. TERMS: $6000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale. FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer. Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
