TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust dated January 8, 2016, and duly recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed of Trust Book 4147, at Page 201, Sally J. Stewart and Timothy E. Stewart did convey unto D. Kevin Moffatt, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Kanawha County Courthouse, in Charleston, West Virginia, on October 15, 2021, at 1:32 PM The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the St. Albans District, Kanawha County, West Virginia, and more particularly described as follows: All that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in the City of St. Albans, Kanawha County, West Virginia, and being more particularly known and designated as being all of Lot No. Eight (8) and the western 1/2 of Lot No. Nine (9) known as No. 9 of Block B, Section One (1), Highlawn, as shown upon a map thereof, of record in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Map Book 2, at Page 95, and which said property is more particularly bounded and described as follows, to-wit: BEGINNING at an old iron pin in the south line of Wilson Avenue, common corner between Lots Nos. 7 and 8 of Block “B” thence with the south line of Wilson Avenue S. 69 degrees 34′ E. 66.15 feet to a stake in the front line of Lot No. 9, thence with a line running through Lot No. 9, S. 16 degrees 26′ W. 106.27 feet to a point in the north line of a ten-foot alley; thence with the line of said alley, N. 73 degrees 34′ W. 60 feet to the rear common corner between Lots 7 and 8 of said Block, thence with the division line between said last named lots, N. 16 degrees 26′ E. 110.44 feet to the place of beginning. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 2415 Wilson Avenue, Saint Albans, WV 25177. AND BEING the same real estate which was conveyed to Sally J. Stewart and Timothy E. Stewart, by Deed dated January 8, 2016, from Ronnie Derrick, and recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed Book 2930, at Page 257. The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
