NOTICE OF TRUSTEE’S SALE NOTICE OF TRUSTEE’S SALE and Notice of the Beneficiary/Servicer’s election to sell property is hereby given pursuant to and by virtue of the authority vested in the Trustee by that certain Deed of Trust dated October 31, 2014, executed by Melba Earl and Charles E. Moore, Sr. to Amy J. Haynie, Trustee, of record in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Book 4063, at Page 209. Bailey & Slotnick, PLLC was appointed as Trustee by CORRECTED APPOINTMENT OF SUCCESSOR TRUSTEE dated September 10, 2021, of record in the Clerk’s Office in Book 4536 at Page 237. The borrowers defaulted under the Note and Deed of Trust and the Trustee has been instructed to foreclose under the Deed of Trust. Accordingly, the Trustee will sell the following described property to the highest bidder at the front door of the Courthouse of Kanawha County, in Charleston, West Virginia, on: THURSDAY, OCTOBER 14, 2021, AT 10:00 O’CLOCK A.M. All those two certain lots, pieces or parcels of land, together with the improvements thereon, situate in Charleston District, Kanawha County, West Virginia, and being all of Lots Nos. 25-A and 25-C as shown upon the map of Resubdivision of Part of Lot No. 25 owned by R. L. Harrah in Coal Branch Heights, Charleston District, Kanawha County, West Virginia, which said lots are shown upon the map thereof made by J. H. Milam, Consulting Engineer, which said map is of record in the office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed Book 1 1 1 1, at page 323, both of which said lots front and abut on the easterly side of Hearth Street, said parcels of land being more particularly bounded and described as follows, to-wit: LOT NO. 25-A BEGINNING at an iron pin in the easterly side of Hearth Street, and running thence N. 3 deg. 23′ E., a distance of 83.21 feet to an iron pin in the common division line between Lots Nos. 25-A and 25-C; thence with the common division line between said two lots, S. 88 deg. 12′ E., a distance of 90.55 feet to an iron pin in the common division line between Lots Nos. 25-A, 25-B, 25-C and 25-D; thence running with the common division line between Lots Nos. 25-A and 25-B, S. 3 deg. 23′ We, a distance of 80.6 feet to an iron pin; thence running N. 89 deg. 51 ‘ W., a distance of 90.64 feet to the place of beginning. LOT NO. 25-C BEGINNING at an iron pin in the easterly line of Hearth Street in the common division line between Lots Nos. 25-A and 25-C; thence running with the easterly line of said street, N. 3 deg. 23′ E., a distance of 83.21 feet to an iron pin; thence leaving said street and running, S. 86 deg. 49′ E., a distance of 90.64 feet to an iron pin in the common division line between Lots Nos. 25-C and 25-D; thence running with the common division line between said two lots, S. 3 deg. 28′ W., a distance of 80.96 feet to an iron pin in the common corner of the division line between Lots Nos. 25 -A, 25-B, 25-C, and 25-D; thence running with the common division line between Lots Nos. 25-A and 25-C, N. 88 deg. 12’ W., a distance of 90.55 feet to an iron pin at the place of beginning. Being the same property conveyed unto Melba Earl and Charles E. Moore, Sr. from CAMC Federal Credit Union, by deed dated October 31, 2014, of record in the office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed Book 2895, at page 98. TERMS OF SALE: 1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property. 2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-2. 3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. 4) The Trustee reserves the right to continue sale of the subject property from time to time by oral or written proclamation, which continuance shall be in the sole discretion of the Trustee. 5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY. 6) The total purchase price is payable to the Trustee by cashier’s check, cash or money order within thirty (30) days of the date of sale, with a minimum deposit of $3,000.00 payable to the Trustee by cashier’s check, cash or money order at the time and place of the sale.
