NOTICE OF SUCCESSOR TRUSTEE’S SALE Notice is hereby given, by virtue of the authority vested in the undersigned Successor Trustees, Eric M. Johnson. and R. Douglas Calderwood, by that certain Deed of Trust made by Sally Ann Cox, dated June 6, 2003 and recorded June 23, 2003 in the office of the Clerk of the County Commission of Kanawha County, West Virginia in Trust Deed Book 3000 at page 645, the said Successor Trustees acting by virtue of that certain Appointment of Successor Trustee dated August 11, 2021 and recorded September 2, 2021 in the aforesaid Clerk’s office in Trust Deed Book 4533, at page 414, and default having been made in the payment of the Note secured by the aforesaid Deed of Trust, and having been requested in writing by the owner and holder of the Note, will offer for sale, at public auction, to the highest bidder at the front door of the Courthouse of Kanawha County, West Virginia, on November 23, 2021 at 9:00 a.m., all that certain lot, piece or parcel of real property, together with improvements thereon, situate in Chesapeake, Chesapeake District, Kanawha County, West Virginia, being more particularly bounded and described as follows: Belonging, situate in south Belle Addition to the Town of Chesapeake, Kanawha County, West Virginia, being described as follows: Parcel No. 1 All that certain piece of parcel of real estate, together with all improvements and appurtenances thereunto belonging, situate in Kanawha County, West Virginia, in Loudon District, being in South Belle Addition, and being Lot Number Thirteen (13) as shown upon the map of said South Belle Addition, made by H. J. Burtnett, C.E., which map is of record in the office of the Clerk of the County Commission of Kanawha County, West Virginia, subject to an easement for flowage given the United States Government. Parcel No. 2 All that certain lot or parcel of land situate, lying and being in the Town of Chesapeake, Loudon District, Kanawha County, West Virginia, and being a part of Lot “A” of the South Belle Addition as shown upon a map of said South Belle Addition, made by H. J. Burtnett, C.E., which said map is of record in the aforesaid Clerk’s Office in Map Book 9, at page 40, the said lot or parcel of land showing part Division Lot “A” South Belle Addition Town of Chesapeake Loudon District, Kanawha County, West Virginia”, said map being dated August 30, 1982, made by Ralph Adkins, Licensed Land Surveyor, a copy of said map being attached to and made a part of that certain deed of record in the aforesaid Clerk’s Office in Deed Book 2013, at page 418, and which said lot or parcel of land hereby conveyed is more particularly bounded and described as follows: BEGINNING at a point on the common division line of Lots Nos. 13 and “A” of South Belle Addition as shown on the maps aforesaid, said point being located N. 5 degrees 53′ E. 39.5 feet from the rear common corner of Lots Nos. 12 and 13 of said South Belle Addition, and at a point common to said Lots Nos. 12, 13 and “A” of said Addition; thence N. 5 degrees 34′ W. 35.00 feet to a point; thence N. 21 degrees 39′ E. 26.00 feet to a point situate on the common division line of Lots Nos. 13 and “A” as aforesaid; thence running with said common division line of Lots Nos. 13 and “A” S. 5 degrees 53′ W. 59.31 feet to the place of beginning, the said lot or parcel of land hereby conveyed containing 208.7 square feet. And being the same property conveyed unto Sally Ann Cox and Jeffrey Wayne Cox, her husband, by deed dated August 15, 1997, of record in the aforesaid Clerk’s Office in Deed Book 2418, at page 734. At the time of execution of the deed of trust, the grantor represented that the address of the property was 11437 Kanawha Avenue, Chesapeake, WV 25315. TERMS OF SALE: The Premises will be sold “AS IS, WHERE IS,” in its present condition and with all faults and defects, if any. The property will be conveyed by deed with no covenants of warranty of title. The property shall be sold subject to all liens not discharged by the sale, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges and liens with priority to the Deed of Trust pursuant to which this sale is being conducted. The property shall be sold subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s office or visible upon the ground. The property will be sold for cash in hand on the date of sale to the highest bidder. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamps to be affixed to the deed). The Successor Trustees and City National Bank of West Virginia shall not be responsible for the removal of any person or personal property from the Premises. Pursuant to the Deed of Trust, the Successor Trustees may postpone the sale by public announcement at the time and place designated and act by agent in the execution of the sale.
