TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated December 8, 2012, and duly recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Book No. 3924, at Page 310, Joyce E Spiroff did convey unto Douglas McElwee, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated August 7, 2019 and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by Quicken Loans Inc. to foreclose thereunder, will offer for sale at public auction at the front door of the Kanawha County Courthouse in Charleston, West Virginia, on December 3, 2019 at 4:30 PM the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in 25-Union District, Kanawha County, West Virginia, and more particularly described as follows: Land Situated in the City of Charleston in the County of Kanawha in the State of WV All that certain lot, tract or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate and being in Union District, Kanawha County, West Virginia, and being more particularly bounded and described as follows Beginning at an old iron pin (found) in the fence line in the Westerly line of Crystal Drive at the common front corner to the parcel of land hereby described and the parcel of land now or formerly owned by Bobby L Caldwell, thence leaving said line of Crystal Drive and running wit the common division line between said parcels and with the existing fence line North 70 degrees 19′ W 175 70 feet to an old iron pin at the common rear corner to said parcels and also being a common corner to the parcel of land, now or formerly owned by Robert F Conley, thence running with the common division line between said parcel of land hereby described and said Conley parcel North 12 degrees 44′ E 51 55 feet to an old iron pin (found), thence running with another common line between said parcels North 75 degrees 46′ W 96 04 feet to an old iron pin (found) in the Easterly line of Barnett Drive, thence leaving said common corner to Conley and running with the Easterly line of Barnett Drive North 20 degrees 59′ E 102 00 feet to a stake at the common corner to said parcel hereby described and the parcel of land, now or formerly owned by Malcolm Gallups, thence leaving said Easterly line of Barnett Drive and running with two common lines between said parcel hereby described and said Gallups parcel south 62 degrees 01′ 30″ E, 29 30 feet to a point, thence running North 22 degrees 36′ E 30 00 feet to an old iron pin (found) at a common corner to said parcels and also the parcel of land, now or formerly owned by William D Ross, thence running South 18 degrees 59’30” E 40 69 feet to an old iron pin (found). thence running South 68 degrees 04′ e 27 18 feet to an old iron pin (found), thence running South 68 degrees 04′ E 135 00 feet to a stake at the common corner to said parcels and also the parcel of land now or formerly owned by John R Soice, thence running South 83 degrees 00 E 53 00 feet to a stake in the westerly line of Crystal Drive at the common front corners:, to said parcels, thence leaving said common corner to Soice and running with the Westerly line of Crystal Drive South 17 degrees 21′ W 142 95 fort to the place of beginning, as shown on a map recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia m Deed Book 2177, at page 815 At the time of the execution of the Deed of Trust, this property was reported to have an address of: 5176 Crystal Dr, Charleston, WV 25313. The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
