NOTICE OF TRUSTEE’S SALE Notice is hereby given that by virtue of the authority vested in the undersigned Trustee by that certain Deed of Trust executed by Samuel J. Osburn and Marci Osburn, to Paul A. Ryker, Trustee, dated February 1, 2020, and recorded in the Office of the Clerk of the County Commission of Cabell County, West Virginia, in Trust Deed Book 2768, at Page 313, by which was conveyed to the said Trustee, the real estate hereinafter described, to secure the payment of a certain security instrument (“note”) set out and described and referenced therein; default having been made in the payment of said note, and the said Paul A. Ryker, Trustee, having been requested to do so by the owner and holder of said note, and having full and absolute power and authority in the premises, the said Paul A. Ryker, Trustee, shall sell to the highest bidder, on Wednesday, the 15th day of December, 2021, at 11:00 a.m., at the east door of the Cabell County Courthouse, in Huntington, West Virginia, the following described real estate: All that certain piece, parcel of lot of property situate in the Town of Milton, Cabell County, West Virginia, being more particularly bounded and described as follows, to-wit: BEGINNING at a point in the east line of Smith Street in the Town of Milton, thirty-one feet and nine inches from the north line of the Chesapeake & Ohio Railway Company’s right of way, on which said right of way U.S. Route No. 60 is now located, said point is also to be at the southwest comer of the main building of what is known as the Heck & Griffith store room (now Heck Funeral Horne); thence running easterly with the south wall of said building a straight line for the distance of seventy (70) feet; thence running in a southerly direction a straight line the distance of thirty-one feet and nine inches to the north line of the Chesapeake & Ohio Railway Company’s right of way, which may now be called the paved road of U.S. Route No. 60; thence running in a westerly direction with said right of way (U.S. Route 60) seventy (70) feet to the east line of said Smith Street; thence running northeasterly direction the distance of thirty-one feet and nine inches to the place of BEGINNING, and being properly a part of Lot known as twenty-seven (27) of the said Town of Milton. TERMS OF SALE: 1. Cash in hand paid on the day of sale. 2. The property will be conveyed in an “AS IS ” condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-way, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property. 3. The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-2-1. 4. The Beneficiary and/or Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. 5. The Trustee and/or Substitute Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee. 6. The Trustee and/or Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
