NOTICE OF SUBSTITUTE TRUSTEE SALE Notice is hereby given, by virtue of the authority vested in the undersigned, JOHN F. LEABERRY, Esq., Substitute Trustee, by that certain Deed of Trust made by DEBORAH LAKE, IN HER CAPACITY AS ADMINISTRATIX OF THE ESTATE OF MURIEL I. BRIGHTWELL, executed and delivered to JOHN F. HUSSELL as Trustee for the benefit of the Noteholder VILLA LAND COMPANY LLC, bearing date March 31, 2017, and of record in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Trust Deed Book 4434, at page 16, the said JOHN F. LEABERRY acting as Substitute Trustee by virtue of that certain Appointment of Substitute Trustee, dated October 14, 2021, of record in the aforesaid Clerk’s Office in Trust Deed Book 4543, at Page 21, and default having been made in the payment of the Note secured by the aforesaid Deed of Trust, and having been requested in writing by VILLA LAND COMPANY LLC in the exercise of the right and authority granted in the said Deed of Trust, does hereby designate and appoint John F. Leaberry, a resident of Greenbrier County, West Virginia, as Substitute Trustee, the undersigned Substitute Trustee will offer for sale, at public auction, to the highest bidder, at the North Front Door of the Courthouse of Kanawha County, West Virginia, on the 28th day of December, 2021, at 10:00 o’clock a.m., the following described real estate situate in St Albans Tax District, City of St Albans, Kanawha County West Virginia and more particularly described as follows: (a) All of Grantor’s interest in those certain tracts or parcels of real property known as Lots 15, 16, and 17, Block 52 in the City of St. Albans, West Virginia with a street address of711 Park Street, St. Albans West Virginia 25177, together with all improvements, buildings and structures at any time now or hereafter erected, situated or placed thereon, and all rights, privileges, easements, hereditaments, appendages, and appurtenances thereunto belonging or appertaining; and (b) All right, title, interest, and estate of Grantor in and to streets, roadways, sidewalks, curbs, alleys and areas adjoining the real estate hereby conveyed and portions thereof and whether vacated by law or ordinance (conditionally or otherwise); and (c) All fixtures, fixed assets and personalty of a permanent nature, owned by Grantor now or at any time hereafter annexed, affixed or attached to the property hereby conveyed and the buildings, improvements or structures thereon and used or intended to be used in the possession, occupation or enjoyment thereof, and all replacements, additions and substitutions thereof or thereto, including, but without limiting the generality of the foregoing, all apparatus, appliances, machinery, equipment, and articles used to supply or provide or in connection with heat, gas, air conditioning, plumbing, water, lighting, power, elevator service, sewerage, refrigeration, cooling, ventilation, sprinkler system and water heater, all of which, described in this item (c), shall be a part of the freehold and a portion of the security for the obligation herein described; and (d) All equipment, materials, supplies and other property of every kind or nature whatsoever, now or hereafter owned by Grantor or in which it has or shall have an interest, procured for incorporation in or to be affixed to buildings or other improvements on the property described above or appurtenances thereto; and existing and future leases for all or any part of the property, together with all rent, income, or other proceeds from the property; and (e) All rentals, proceeds, revenues, and other income from the afore mentioned land, buildings and improvements or any part thereof; but so long as Grantor is not in default hereunder, Grantor may collect and receive all of said income. and of record in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed Book 2535 at page 0775. TERMS OF SALE: Cash in hand at time of sale, subject to all easements, covenants, reservations, conditions, prior liens and encumbrances, liens for real estate taxes, incinerator, sanitary and sewer charges. Trustee assumes no responsibility to maintain, preserve or monitor the above-described real estate, nor assumes obligation to ensure that any party or person in possession of said real estate surrenders or vacates said real estate upon completion of the Trustee’s Sale.
