NOTICE OF TRUSTEE’S SALE NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated January 10, 2006, executed by Borrower(s), Bobby Black and Shirley Faye Black, to Teays Valley Road, the Trustee of record in the office of the Clerk of the County Commission of Cabell County, West Virginia, in Book 2060, at Page 409. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 2502 Old US Rt 60 n/k/a 2502 Old US Rt 60 E, Ona, WV 25545. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated October 5, 2021, of record in the Clerk’s Office in Book 409, Page 535. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Cabell County, in Huntington, West Virginia, on the following date: 14th day of January, 2022 at 10:45 a.m. All that certain lot, piece or tract of real estate situate on the south side of the West Virginia State paved road, U.S. Route 60, East of Old Ona, in Grant District, Cabell County, West Virginia, bounded and described as follows: Beginning at a stake in the southerly right-of-way line of State Road No. 60 at the northwesterly corner of a tract of land conveyed by Ezra K. France to John and Roy Adkins, thence with said right-of-way lines S. 77 20` W. 151.5 feet to an iron stake; thence leaving said right-of-way line S, 73 55` W. 538 feet to a set stone; thence up the hill S. 55 10` E. Passing through a 5 inch Hickory at 133 feet in all 265 feet to a set stone; thence N. 77 15` E 233.7 feet to a set stone; thence S. 54 35` E. 387 feet to a set stone in the line of the tract of land conveyed by Erza K. France to John and Roy Adkins; thence with the Adkins Line N. 19 35` W, 115.4 feet to a 10 inch ash on the west side of a drain; thence N. 3 45` W, 116.5 feet to a 12 inch Sycamore on the east side of a drain; thence N. 22 15` W. 113 feet to a locust fence post; thence N. 5 10` E. 59 feet to a locust fence post; thence N. 9 45` W. 99 feet to the beginning, containing 3.17 acres, more or less. Being the same property conveyed to Bobby Black and Shirley Faye Black by the Deed dated November 5, 1993 and recorded in Deed Book 969 at Page 20 in the Office of the Clerk of the County Commission of Cabell County, West Virginia. Excepting and Reserving the following outsales: 1. To Donald J. Black and Nancy C. Black from R.L. Black and Una Black, his wife by Deed dated the 2nd day of January, 1970, in Deed Book No. 684, at page no. 15, and described as follows: Beginning at an iron stake in the southerly right of way line of former State Road No. 60; thence, southerly, a straight course, 75 feet to an iron stake; thence, westerly, 70 feet, to an iron stake, on a straight course parallel with but 75 feet from the said southerly right of way line of former Route 60; thence, northerly, a straight course, 75 feet to said right of way line; and thence with said road right of way line, easterly 70 feet to the place of beginning. 2. To Gerald S. Keeney and Doris Jean Keeney form R.L. Black and Una Black, his wife, by deed dated the 14th day of December, 1978, and of record in Deed Book No. 795, at page no. 544, and described as follows: Beginning at a Hickory corner of Oliver Beckett and F. K. France, thence North 46 W. 117 feet to a stake in the south line of U.S. Route No. 60; thence with the south line of Route No. 60 N. 75 E. 78 feet to a stake; thence leaving Route No. 60 S. 8 15` E. 104 feet to the place of beginning, containing about 1/8 an acre more or less. Beginning at a hickory tree, corner to Kenney and Erza France, thence N. 55 10` W 130.09 feet to a 1/2 inch steel pipe in U.S. Route No. 60 right of way; thence N. 74 05 E. 24.0 feet to a 1 inch steel pipe on said right of way; thence S. 46 E. 116.40 feet to the place of beginning, and containing .028 acres, more or less. 3. Donald J. Black and Nancy C. Black from R. L. Back and Una Black, by deed dated the 14th day of September, 1983, in Deed Book No. 845, at page no. 468, and being described as follows: Beginning at a 1/2″ steel rod, corner to J. Coliflower and U.S. Route 60; thence N. 74 05` E. 22.0` to a 1/2″ steel rod, running with Route 60; thence N. 73 55` E. 448.82` with said Highway, to a T-Rail, corner to R. L. Black and Route 60 R/W; thence S. 3 04` E. 323.90` leaving Route 60 and going to a set stone on the Hill. Thence N. 54 35` W. 123.30` to a set stone; thence S. 77 15` W. 233.70` to a set stone; thence N. 55 10` W. 135.64` going back down the Hill to a 1″ Steel pipe referenced by a 15″ Hickory Tree; thence N. 17 25` W. 100.19` to a 1/2″ steel rod, the place of Beginning, containing 2.22 acres, more or less. Also being a part of Property recorded in Deed Book No. 795, at page no. 546. Assessed for 2005 property tax at 0.826 property remaining. TERMS OF SALE: 1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property. 2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-1. 3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. 4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee. 5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY. 6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
