NOTICE OF TRUSTEE’S SALE NOTICE OF TRUSTEE’S SALE is hereby given to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated February 12, 2021, executed by Borrower(s), McGuffin Tully Nobel Properties LLC dba MTN Properties and Downtown Auto Title & Notary LLC dba Time Saver Auto Title & Notary, Samuel Augustus McGuffin, Ian Matthias Noble and Peter McKinley Tully, to RES Title, Inc., the Trustee of record in the office of the Clerk of the County Commission of Cabell County, West Virginia, in Book 2826, at Page 302. At the time of the execution of the Deed of Trust, the properties were reported to have a mailing addresses of 556 Washington Ave & 1411 5th Ave, Huntington, WV 25701. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated September 14, 2021, of record in the Clerk’s Office in Book 408, Page 657. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Cabell County, in Huntington, West Virginia, on the following date: 22nd day of February, 2022 at 10:15 a.m. PARCEL A: The land in City of Huntington, County of Cabell, State of West Virginia, more particularly described as follows: All that certain piece, parcel or lot of land, 60 by 200 feet, situate, lying and being in the City of Huntington, Cabell County, West Virginia, and laid down and designated on a certain map of the said City of Huntington, made by Rufus Cook, Surveyor, a lithograph copy of which was filed in Recorder`s Office of said Cabell County, on the 6th day of December, 1871, as Lot No.2, in Block No. 160. This conveyance is made subject to any and all covenants, restrictions, easements and reservations which may be a matter of record in the Clerk`s Office aforesaid and running with the land. Being the same premises conveyed in deed dated 8/27/2020 and recorded 9/17/2020 at Book 1432, Page 694. PARCEL B: All those certain Lots, pieces or parcels of land, situate in the City of Huntington, Cabell County, West Virginia, in that part thereof formerly known as Central City, known and designated on a map of said Central City, made by George McKendree, Civil Engineer, filed in the Office of the Clerk of the County Commission of Cabell County, West Virginia, on the 3rd day of October, 1891, as the southerly 125 feet of Lots Numbers Sixteen (16) and Seventeen (17), and the southerly 125 feet of the westerly 20 feet of Lot Number Eighteen (18), in Block Number Twenty-two (22), bounded and described as follows: Beginning at the point of intersection of the north line of Washington Avenue with the east line of Sixth Street West; thence with the said line of Washington Avenue, Easterly 70 feet; thence Northerly and parallel to the said line of Sixth Street West, 125 feet; thence Westerly and parallel to the said line of Washington Avenue, 70 feet to a point in the said line of Sixth Street West; thence with said line Southerly 125 feet to the point of beginning. This conveyance is made subject to any and all covenants, restrictions, easements and reservations which may be a matter of record in the Clerk’s Office aforesaid and running with the land. TERMS OF SALE: 1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property. 2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-1. 3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. 4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee. 5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY. 6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
