Stevens, Unknown Persons/Owner, and Sherill Parker, Sheriff of Wyoming County, West Virginia (hereinafter sometimes referred to as “the aforementioned respondents”), that a Petition for Condemnation/Right of Entry has been filed in the Circuit Court of Wyoming County, West Virginia, and is known as Civil Action No. 19-C-14, and styled Appalachian Power Company v. G. Michael Stevens, et al. Said Petition for Condemnation/Right of Entry under the West Virginia laws of eminent domain seeks property for the construction of electrical transmission, distribution, and communication lines and appurtenant equipment and fixtures, and condemnation and right of entry on behalf of Appalachian Power Company situate on the Marsh Fork of Rock Castle Creek, in Center District, Wyoming County, West Virginia, identified as Tax Map 108, Parcel 13.4, and recorded in the office of the Clerk of the County Commission of Wyoming County, West Virginia, in Deed Book 377, at page 643, and being more particularly described as follows: BEGINNING at a point at the Southwestern edge of the right-of-way line of West Virginia State Route No. 10 at the Northwestern edge of the 15 foot Access Road leading to the one (1) acre tract heretofore conveyed to John David Jackson and Sharon Jackson, husband and wife, by Merlie Stewart Rutherford, Widow, by deed dated July 5, 1971, and of record in the Office of the Clerk of the County of the County Commission of Wyoming County, West Virginia, in Deed Book No. 260, at page 370, as the same is shown and designated on that certain map or plat of record in said Clerk’s Office in Map File No. 1577; thence in a southwesterly direction with the Northwestern edge of said 15 foot Access Road for a distance of 300 feet to a point at the edge of said 15 foot Access Road; thence leaving said 15 foot Access Road and running in a Northwesterly direction on a line parallel with the southwestern right-of-way line of West Virginia State Route No. 10 to the southwestern corner of that three-eighths (3/8ths) acre tract of real estate heretofore conveyed to James W. Rutherford by Merlie Rutherford and William Rutherford, her husband, by deed dated April 3, 1950, and of record in the Office of the Clerk of the County Commission of Wyoming County, West Virginia, in Deed Book No. 143, at page 299; thence in a Northeasterly direction with the southeasterly boundary line of said three eighths (3/8ths) acre tract of real estate for a distance of 300 feet to the corner of said tract of real estate at the southwestern edge of the right-of-way line of West Virginia State Route No. 10; thence leaving said tract of real estate and in a Southeasterly direction with the Southwestern edge of the right-of-way line of West Virginia State Route No. 10 to the point of beginning, and containing Three (3) Acres, more or less. The aforementioned respondents are hereby notified a copy of said Petition for Condemnation/Right of Entry may be obtained from the Wyoming County Circuit Clerk’s office at Wyoming County Courthouse, 24 Main Avenue, Pineville, West Virginia, 24874, for the purposes of appearing and defending. The Petition for Condemnation/Right of Entry may also be obtained from the attorneys for Appalachian Power Company, Stephen F. Gandee, Post Office Box 128, 140 West Main Street, Suite 300, Clarksburg, West Virginia, 26302-0128, or Douglas C. McElwee, 700 Virginia Street East, Suite 400, Charleston, West Virginia, 25301. The aforementioned respondents are further notified that a hearing on the said Petition for Condemnation/Right of Entry will occur on June 19, 2019, at 10:00 a.m., in the Circuit Court of Wyoming County, West Virginia, located at Wyoming County Courthouse, 24 Main Avenue, Pineville, West Virginia, 24874, before the Honorable Warren R. McGraw. You may appear for hearing as stated above, and are notified that any failure to appear may result in the waiver of any defenses or claims, if any, you may have.
