NOTICE OF TRUSTEE’S SALE NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated April 4, 2008, executed by Borrowers, Linda L Gilliam and Robert L Gilliam, to Philip Hereford, the Trustee of record in the office of the Clerk of the County Commission of Kanawha County, West Virginia, in Book 3557, at Page 589. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 1114 Londonberry Rd, Charleston, WV 25314. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated January 9, 2020, of record in the Clerk’s Office in Book 4407, Page 734. The borrowers defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Kanawha County, in Charleston, West Virginia, on the following date: 22nd day of March, 2022 at 11:15 a.m. All of that certain lot, piece or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, lying and being situate in the City of Charleston, Charleston South Annex Tax District (formerly Loudon Tax District), Kanawha County, West Virginia, and being known and designated as Lot No. Thirty-nine (39) of the Third Section of Emerald Heights as shown upon a map of the same, entitled “Third Section of Emerald Heights in the City of Charleston, Loudon District, Kanawha County, West Virginia”, dated August 17, 1968, which map was placed of record in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, on December 6, 1968. This lot and all other lots in the Third Section of Emerald Heights are subject to those certain protective covenants, restrictions, easements and reservations, set forth and contained in that certain deed from Emerald Land Company, a corporation, to George E. Bowers, dated December 12, 1968, of record in the aforesaid Clerk`s Office in Deed Book 1543, at Page 421. This conveyance is further made expressly subject to the easements heretofore granted to Hugh N. Mills by Emerald Land Company, a corporation, by Deed dated December 12, 1973, of record in the aforesaid Clerk`s Office in Deed Book 1715, at Page 698, which easement is shown upon the map attached thereto, entitled in part “30 ft. Easement and Resubdivision of Lots 38 and 39 Third Section Emerald Heights”. The parties of the first part grant and convey unto the parties of the second part, their heirs and assigns, the right to use said easement as a means of ingress and egress to and from the property hereby conveyed, subject to a similar right of usage by the owners of Lot 38. This conveyance is further made expressly subject to the easement of a six (6) inch gas line across the rear of said lot and to a Union Carbide gas line crossing said lot between the residence and Skytop Circle. This conveyance is made subject to any and all covenants, restrictions, and easements as the same may appear in instruments of record in the aforesaid Clerk`s Office. Being the same property conveyed to Linda L Gilliam and Robert L Gilliam by the Deed dated June 16, 1988 and recorded in Deed Book 2206 at Page 141 in the Office of the Clerk of the County Commission of Kanawha County, West Virginia. Robert L Gilliam departed from this life on March 6, 2012, thereby vesting title to Linda L Gilliam, by virtue of survivorship provisions in said deed.
