NOTICE OF TRUSTEE’S SALE

NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated July 19, 2019, executed by Borrowers, Michael Cook and Kimberly Reed, to Richard A. Pill, the Trustee of record in the office of the Clerk of the County Commission of Mercer County, West Virginia, in Book 1375, at Page 444. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 557 Old Bluefield Rd, Princeton, WV 24739. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated July 24, 2020, of record in the Clerk’s Office in Book 1396, Page 195. The borrowers defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Mercer County, in Princeton, West Virginia, on the following date:

28th day of October, 2020
at 11:00 a.m.

That certain real estate located in PRINCETON DISTRICT, MERCER COUNTY, WEST VIRGINIA, and more particularly described as follows:
Parcel No. 9 of the Scarlet Oaks Townhouse Complex on a certain plat entitled “Plat of Survey Showing Division of the Harold L. Belcher Tract As Described in Deed Book 530 at page 464 and 466 and Deed Book 561 at page 746 which is situate at the City of Princeton, Mercer County, West Virginia, Dana Pettrey and Associates, P.O. Box 641, Athens, West Virginia, Date: 9/2/80, Revised 5/26/82, 8/29/85, Scale: 1″ = 30′, Dana L. Pettrey” which Plat is recorded in the Office of the Clerk of the County Commission of Mercer County, West Virginia, as Mircofilm Plat Record #9053, and more particularly bounded and described as follows:
BEGINNING at a point in the easterly line of the common parking area at the common corner of Parcels 8 and 9 as shown upon said Map; thence with the dividing line between Parcels 8 and 9, N. 51 24′ 45″ E. 102.432 feet to a point; thence S. 39 03′ E. 18.001 feet to a point, the common corner of Parcels 9 and 19; thence, with the dividing line between Parcels 9 and 10, S. 51 24′ 45″ W. 102.577 feet to a point in the eastern line of the common parking area and with the same, N. 38 35′ 15″ W. 18.0 feet to the point of BEGINNING, together with all of the rights and interest appurtenant to parcels in the Townhouse Complex, and subject to all of the provisions of the Declaration of Condominium Pursuant to Uniform Condominium Act. Chapter 36B of the West Virginia Code, dated October 8, 1980, of record in said Clerk’s Office in Deed Book No. 592, at page 217.
AND BEING the same property conveyed unto Robert Brian Biroscak and Gail M. Biroscak from Leslie White by deed dated June 27, 2013 of record in the Office of the Clerk of the County Commission of Mercer County, West Virginia in Deed Book 992 at page 687.

Being the same property conveyed to Kimberly Reed by the Deed dated July 15, 2019 and recorded in Deed Book 1079 at Page 155 in the Office of the Clerk of the County Commission of Mercer County, West Virginia.

TERMS OF SALE:

1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.

2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-1.

3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.

4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.

5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
