FORECLOSURE SALE
OF VALUABLE RESIDENTIAL REAL ESTATE

Upon notification by the holder of a Note secured by the Deed of Trust described below of a default and having been requested to institute these proceedings, and by virtue of the authority vested in us under that certain Deed of Trust dated the 28th day of November, 2016, executed by Linda D. Coleman unto Gary R.Mills, as Trustee, which said Deed of Trust is of record in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Trust Deed Book 1328, at Page 142, which said Deed of Trust secured First Community Bank, and pursuant to a Substitute of Trustees dated February 1, 2019, and recorded February 7, 2019, in Trust Deed Book 1367, at Page 695, whereby the undersigned were substituted as trustees in place and stead of the said Gary R. Mills, we will
ON THE 23rd DAY OF April, 2019, AT 10:00 O’CLOCK A.M., at the front door of the Mercer County Court House (being the North Walker Street side) at Princeton, Mercer County, West Virginia, offer for sale at public auction to the highest bidder, the following residential property, to-wit:
“All that certain lot or parcel of land situate in Beaver Pond District, Mercer County, West Virginia, as shown upon a Map bearing the legend, “Plat of Resurvey Showing Parcel No. 5 and Extension of the D.T. Carr Addition. Surveyed by Elmer C. Barton May 31, 1971. Located Beaver Pond District Mercer Co. W. Va. Resurveyed by Charles L. Harvey Jr.; Princeton W.Va. on May 16, 1975. Scale l” = 20′ s/s Charles L. Harvey, Jr.” and more particularly bounded and described as follows:
‘BEGINNING at an iron pin in the southeasterly line of the 36 feet wide access road shown upon said Map; thence from said BEGINNING point Chord N. 8deg. 00′ E. 152.51 feet to an iron pin and continuing with said Road N. 16deg. 34′ W. 75.25 feet to an iron pin; Chord N. 20deg. 46′ E. 26.73 feet to an iron pin; and N. 48deg. 40′ E. 87.87 feet to an iron pin; thence leaving said road S. 46deg. 10′ E. 163.84 feet to an iron pin; thence S. 46deg. 19’ W. 272.53 feet to the point of BEGINNING, containing 0.62 of an acre, more or less.'”
And being the same property conveyed unto Noah M. Coleman and Linda D. Coleman by deed of Linda D. Coleman and Noah M. Coleman dated December 1, 1998, and of record in the Office of the Clerk of the County Commission of Mercer County, West Virginia in Deed Book 802 at page 140. The said Noah M. Coleman died testate on February 12, 2003, with the property vesting in Linda D. Coleman by virtue of the survivorship clause in the said deed.
“This subdivision is restricted to residential use only, with no commercial or business facilities to be erected on any of the lots shown upon said Map and no commercial or business enterprises to be conducted thereon, and this Subdivision is further restricted for the use and enjoyment of the owner of the respective lots therein.”
“There is further reserved from the operation of this conveyance an easement for utility lines over the above described property for the benefit of the owners of the lots in said Subdivision.”
The terms of the sale shall be cash in hand on the day of sale (or such other arrangement as may be satisfactory to Trustee and holder of the Note) and said property is being sold in “as is” condition. Said sale is subject to all taxes now due or to become due on said property, all liens, including but not limited to sewer liens and restrictions, easements or other matters of record in said Clerk’s Office affecting the title to said property. The purchaser is to pay the excise tax on the privilege of transferring said real estate.
In the event there are federal tax liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale, or the period allowable for redemption under local law, whichever is longer.
Notice is also given that any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
