NOTICE OF TRUSTEE’S SALE

In execution of the deed of trust, dated June 23, 2016, from Mark Warner and Helen Warner to J. Peter Richardson, as trustee, of record in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Trust Deed Book 1318, at page 758, the undersigned trustee will offer for sale at public auction on July 9, 2019, at 10:00 a.m. at the front door of 307 Federal Street, Bluefield, West Virginia, all those certain tracts or parcels of real estate situate in the City of Bluefield, Mercer County, West Virginia, and which property is more particularly bounded and described as follows:

Lots 5 and 61 Section 950:

BEGINNING at a point in the south line of Parkway, formerly known as Lakeside Avenue, which said point is the northeast corner of Lot 4, in said Section 950, and is located by the following two courses and distances from the point of junction of said south line of Parkway with the east line of Bland Road, formerly known as Memorial Avenue; N. 65deg. 28′ E. 344.5 feet to a point marked by a stake; and thence, N. 63deg. 59′ E. 112 feet to a point marked by a stake, the point of BEGINNING; thence, continuing with said south line of Parkway, N. 63deg. 59′ E. 130 feet to a point, the northwest corner of Lot 7, in said Section 950; thence with the west line of said Lot 7, S. 26deg. 01′ E. 212.5 feet to a point marked by a stake; thence S. 69deg. 27′ W. 131 feet to a point, the southeast corner of said Lot 4; thence with the east line of said Lot 4, N.26deg. 01′ W. 201 feet to the point of BEGINNING

This sale will include all rights, easements, appurtenances, improvements and structures that are part of the real estate described above. This sale will be subject to all restrictions, rights-of-way, conditions, easements and matters of record, mechanics’ and materialmen’s liens, if any, whether of record or not of record, and unpaid real estate taxes, to the extent any of the foregoing apply and take priority over the lien of the deed of trust.

TERMS OF SALE: Cash in hand on day of sale. The conveyance of the real estate will be by a deed without any covenant or warranty, express or implied. The real estate and any improvements thereon will be sold in “as is” condition without any warranties. The successful bidder will assume the risk of all loss or damage to the real estate and any improvements thereon after the sale, and be responsible for all costs of the conveyance including, but not limited to, any examination of title, preparation of the deed, excise tax and recording fees. Any announcements made at the sale, including postponement of the sale and withdrawal of the real estate from sale, will take priority over published notices.
