For Modification of a Dam
Notice is hereby given that Mr. James Powers has applied for approval to modify the Mackenzie Lake Dam, located on the unnamed tributary of Spring Creek, 4.4 miles upstream of Esty, Greenbrier County, West Virginia.
The dam is an earth fill structure used for recreation and aesthetic purposes, constructed in approximately 2008. Upon completion of modifications, the dam will be provided a vegetated auxiliary spillway channel on the north abutment. The channel will be 20 feet wide at elevation 2757.8 with 5:1 side slopes. The dam will remain at 22.6 feet in total dam height. The normal reservoir volume will remain at 85 acre-feet, and the maximum reservoir volume will remain at 105 acre-feet. The capacity of the dam to store or discharge rainfall will be 7 inches in six hours. The hazard potential classification is “3” (Low Hazard), meaning that failure of the dam may cause minor damage to nonresidential and normally unoccupied buildings, or rural or agricultural land. The potential for loss of human life is unlikely.
The land surface covered by this application and the dam are owned by James and Bonnie Powers, and legal right to conduct operations is by deed.

Any person who may be adversely affected by issuance of a Certificate of Approval may request a hearing, provided that such request be in writing, contain specific objections to the issuance of the Certificate of Approval and be received by the Dam Safety Section within fifteen (15) days of this publication.
