The undersigned Substitute Trustees, by virtue of the authority vested in them by that certain Deed of Trust dated December 4, 1998, and duly recorded in the Office of the Clerk of the County Commission of Marion County, West Virginia, in Deed of Trust Book 668, at Page 1159, Billie L. Morgan, Jr. and Paula Jean Morgan did convey unto Anthony J. Julian and Douglas J. Leech, Trustees, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Richard A. Pill and David D. Pill as Substitute Trustees by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustees having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Marion County Courthouse, in Fairmont, West Virginia, on

The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Lincoln District, Marion County, West Virginia, and more particularly described as follows:
All that certain tract of parcel of real estate, together with the improvements thereon and the appurtenances thereunto belonging, situate in “Traction Park”, in the Town of Monongah, Lincoln District, Marion County, West Virginia, and which tract or parcel of real estate is more particularly bounded and described as follows:
Beginning at an iron pipe found in the northern right of way line of a 20′ wide street; thence with three lines of said street, N. 47 deg. 22′ 05″ W. 86.06 feet to an iron pin set; thence a curve to the left with a radius of 420.00 feet and a length of 45.57 feet to an iron pin set; thence N. 54 deg. 01′ 00″ W. 167.96 feet to an iron pin set; thence N. 11 deg. 58′ 35″ E. 7.23 feet to an iron pin found; thence N. 39 deg. 25′ 06″ E. 168.74 feet to an iron pipe found; thence S. 72 deg. 47′ 01″ E. 133.35 feet to an iron pipe found; thence N. 21 deg. 16′ 36″ E. 134.88 feet to a roof bolt found; thence S. 57 deg. 22′ 25″ E. 86.86 feet to a roof bolt found at the northwestern corner of the Catholic Church cemetery tract; thence S. 34 deg. 39′ 53″ W. 348.10 feet to a roof bolt found; thence S. 58 deg. 19′ 23″ E. 104.00 feet to an iron pin found; thence S. 33 deg. 19′ 54″ W. 26.82 feet to the point of beginning, containing 1.35 acres, more or less, as shown on a survey prepared by Wolfe & Associates, Inc., dated November 25, 1998.
At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of
Hillside Drive,
Monongah, WV 26554.
AND BEING the same real estate which was conveyed to Billie L. Morgan, Jr. and Paula Jean Morgan, by Deed dated November 30, 1998, from Lucille DeCarlo, and recorded in the Office of the Clerk of the County Commission of Marion County, West Virginia, in Deed Book, 950 at Page 1008.
The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustees shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: Ten percent (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of the purchase price as a cash deposit with the balance due and payable within 30 days of the day of sale.
