The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated August 12, 2008, and duly recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed of Trust Book 5032, at Page 6466, Jason E. Cyrus and Angela Cyrus did convey unto Otis L. O’Connor, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Raleigh County Courthouse, in Beckley, West Virginia, on

The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Shady Spring District, Raleigh County, West Virginia, and more particularly described as follows:
BEING that certain parcel of land located in THE OAKS SUBDIVISION, together with any improvements and the appurtenances thereunto belonging, located in Shady Spring District, Raleigh County, West Virginia, being a PART OF LOT NO. FIFTY-SEVEN (57), being more particularly bounded and described as follows:
BEGINNING at a point in the North Right of Way line of Route No. 9, Project I-64 (57) 116, point being 50 feet left of Center Sta. 9+30, point also being in the original dividing line of Lots Nos. 57 and 58; thence leave said Route No. 9 and with the dividing line of Lots 57 and 58, N. 33 degrees 05′ 28″ W. for 130.00 feet to a point, said point being a common corner to Lots Nos. 57, 58, 94 and 95; thence leave Lots 58 and 94 and with the dividing line of Lots Nos. 57 and 95, N. 56 degrees 54′ 32″ E. for 100.00 feet to a point, said point being a common corner to Lots Nos. 56 and 57; thence leave Lot No. 95 and with the dividing line of Lots Nos. 56 and 57, S. 33 degrees 05′ 28″ E. for 117.99 feet to a point in the aforesaid Right of Way, point being 62.01 feet left of Center Line Sta. 10+30; thence leave Lot No. 56, and with said right of way, S. 50 degrees 03′ 37″ W. for 100.72 feet to the BEGINNING, containing 12,340 square feet as surveyed by Donnie J. Lilly, L.L.S., October 31, 1992.
At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 2193 Grandview Road, Beaver, WV 25813.
AND BEING the same real estate which was conveyed to Jason E. Cyrus and Angela Cyrus by Deed dated March 25, 2005, from Rita K. Anderson, and recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed Book5017, at Page 2544.
The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: Ten percent (10%) of the purchase price as a cash deposit with the balance due and payable within 30 days of the day of sale.
