NOTICE OF TRUSTEE’S SALE NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustees, Richard A. Pill, David D. Pill and Amanda E. Steiner, by that certain Deed of Trust dated October 12, 2010, executed by Borrower Richard Walker, to Vance Golden, the Trustee of record in the office of the Clerk of the County Commission of Mercer County, West Virginia, in Book 1198, at Page 310. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 822 Thornton Ave, Princeton, WV 24740. Richard A. Pill, David D. Pill and Amanda E. Steiner were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated January 16, 2015, of record in the Clerk’s Office in Book 1290, Page 208. The borrower defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Mercer County, in Princeton, West Virginia, on the following date: May 1, 2015 at 2:00 p.m. The property is described as of that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in East River District, Mercer County, West Virginia, and being more particularly described as follows: All of those two certain lots or parcels of real estate situate in East River District, Mercer County, West Virginia, and more particularly bounded and described as follows: LOT NO. 239: “all of that certain lot or parcel of land situate in East River District, Mercer County, West Virginia, and being Lot No. 239 of Lilly Grove Addition to the City of Princeton, Mercer County, West Virginia, as shown by a Map thereof incorporated in and recorded with a deed from the J. H. Lilly Land Company, a Corporation, to George W. Terry and wife, dated August 20, 1945, and recorded in the Office of the Clerk of the County Court of Mercer County, West Virginia, in Deed Book No. 273, at Page 358. A copy of said map is also filed in said Clerk’s Office in Map Book No. 2, at Page 153. Reference is here made to said Map and Deed.” “The said lot hereby conveyed fronts One Hundred (100) feet on Thornton Avenue, and extends back therefrom with Lot No. 240, a distance of 332.70 feet to Pearl Street, and back on opposite side with Lot No. 238, a distance of 276.44 feet to said Pearl Street, bordering thereon 105.1 feet.” LOT NO. 238: “all that certain lot or parcel of land designated as Lot No. 238, of Lilly Grove Addition to the City of Princeton, West Virginia, as shown upon a map thereof, of record in the Office of the Clerk of the County Court of Mercer County, West Virginia, in Deed Book No. 273, at page 358, as well as in Map book No. 2, at page 153”, which said lot is more particularly bounded and described as follows: “BEGINNING at a point in the southeasterly line of Thornton Avenue, 223 feet distant from the point of intersection of the southeast line of Thornton Avenue with the west line of Pearl Street, at the common corner of Lots 237 and 238; thence with the dividing line between said Lots 237 and 238, S. 80? 17′ E. 202.79 feet to a point in the west line of Pearl Street; thence with the west line of Pearl Street, S. 11? 45′ E. 99.25 feet to a point, common corner of Lots 238 and 239; thence with the dividing line between said Lots 238 and 239, N. 80? 17′ W. 276.44 feet to a point in the southeast line of Thornton Avenue; and thence with the same, N. 30? 36′ E. 50 feet, N. 33? 44′ E. 50 feet to the point of BEGINNING.” And being the same property conveyed to Richard D. Walker by Rebecca Faye Via Lambert, by Deed dated September 14, 2010, to be recorded in the Office of the Clerk of the County Commission of Mercer County, West Virginia, simultaneously with this instrument. Being the same property conveyed to Richard D. Walker by the Deed dated September 14, 2010 and recorded in Deed Book 954, at Page 670 in the Office of the Clerk of the County Commission of Mercer County, West Virginia; and further being the same property conveyed to Richard D. Walker and Patricia J. Walker by the Deed dated January 5, 2012 and recorded in Deed Book 971, at Page 118. TERMS OF SALE: 1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property. 2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code ? 11-22-1. 3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. 4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee. 5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY. 6) The total purchase price is payable to the Trustee by certified or cashier’s check within thirty (30) days of the date of sale, with ten (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of the total purchase price payable to the Trustee at sale by certified or cashier’s check.
