TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated August 20, 2009, and duly recorded in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Book No. 1173, at Page 294, Charles D. Adkins and Catherine Y. Adkins did convey unto Douglas E. Hayes, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated November 10, 2014 and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by Wells Fargo Bank, N.A. to foreclose thereunder, will offer for sale at public auction at the front door of the Mercer County Courthouse in Princeton, West Virginia, on January 8, 2015 at 1:30 PM the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in Beaver Pond District, Mercer County, West Virginia, and more particularly described as follows: “all that certain tract or parcel of real estate designated as “Tract B” on a plat entitled, “Map showing tracts “A” & “B” – PT. Lots 34-37 A. L. Perdue Subd. – Perdue St. – Brushfork Beaver Pond District, Mercer County, WV date: 07/08/09″ by Appalachian Engineering & Surveying, Inc. Jon W. Looney, P.S., and which said parcel is more particularly bounded and described as follows: “BEGINNING at an iron bar in the northern right-of-way line Perdue Street, said bar being the southwest corner of Parcel 130 Tax Map 25 and the southeast corner of Lot 37 and the herein described tract; thence along said right-of-way N. 61? 49′ 10″ W. 60.75 ft. to a point, said point located N. 61? 49′ 10″ W. 2.21 ft. From a PK nail; thence leaving said right-of-way and through Lot 35 for the next two calls: N. 07? 59′ 24″ E. 46.52 ft. to a point, said point located S. 87? 33′ E. 2.50′ from a PK nail; S. 87? 33′ E. 2.50 ft. to a PK nail; thence along the dividing line of Lots 35 and 36 N. 02? 27′ E. 29.00 ft. to an iron bar; thence through Lots 36 and 37 for the next two calls: S. 65? 46′ 47″ E. 30.46 ft. to a gate post; N. 56? 41′ 31″ E. 25.02 ft. to a point, said point located S. 58? 07′ 33″ W. 1.52 ft. from a corner chain link fence post; thence along the western line of Parcel 130 and a fence line S. 02? 55′ W. 105.00 ft. to the point of BEGINNING and containing 4,337 sq. ft. more or less.” AND BEING the same real estate conveyed unto the Parties of the First Part herein by Deed dated August 12, 2009, from Joyce Billips, a married woman, which deed is intended to be recorded simultaneously herewith. This conveyance is made expressly subject to all pertinent restrictions, reservations and easements of record. At the time of the execution of the Deed of Trust, this property was reported to have an address of: Route 4 Box 90AAA, Bluefield, WV 24701. The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. TERMS: $5,000.00 in cash and/or certified funds as deposit with the balance due and payable within 30 days of the day of sale. FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer. Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
