NOTICE OF TRUSTEE’S SALE NOTICE IS HEREBY GIVEN that by virtue of that certain Deed of Trust dated May 11, 2010, executed by Paul J. Martini, Sr. and Doreen J. Martini to Gary R. Mills and Stephen M. Feola, Trustees, of record in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Trust Deed Book 1188, at page 237, and by Credit Line Deed of Trust executed by Paul J. Martini, Sr. and Doreen J. Martini to Gary R. Mills and Stephen M. Feola, Trustees, of record in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Trust Deed Book 1217, at page 154, David M. Kersey having been substituted as Trustee pursuant to Substitution of Trustee of record in the aforesaid Clerk’s office in Trust Deed Book 1294, at page 623, default having occurred in payment of the indebtedness secured by said deeds of trust, and the undersigned substitute trustee having been requested to do so by First Community Bank formerly First Community Bank, N. A., owner and holder of the indebtedness secured by said deeds of trust, the undersigned substitute trustee will offer for sale and sell at public auction on Monday, June 8, 2015, at 10:00 a.m., at the north entrance to the Mercer County Courthouse, Princeton, Mercer County, West Virginia, the following descried real estate, together with the improvements thereon and appurtenances thereunto belonging, more particularly bounded and described as follows: All that certain tract or parcel of real estate, together with the improvements thereon and easements and appurtenances thereunto belonging, designated as Lot 20, on “PLAT SHOWING VALLEY VIEW ESTATES NO II-PHASE II, LYING ON THE WATERS OF BRUSH CREEK OF BLUESTONE RIVER, BEAVER POND DISTRICT, MERCER COUNTY, SITUATE FOUR MILES SOUTHWEST OF PRINCETON, GREEN VALLEY, WEST VIRGINIA, SCALE: 1″ = 80′, JUNE OF 1998″ which map is of record as Microfilm Plat No. 13268, and which property is more particularly bounded and described as follows: BEGINNING at a 1/2″ rebar found on the eastern line of a 40.08 tract owned by Homer C. Winfrey, et al., and being the northwestern corner of Lot 10; thence with the eastern line of said 40.08 acre tract along the remnants of a wire fence, N. 00? 00′ E. 224.37 feet to a 1/2″ rebar set, being the southwestern corner of Lot 19; thence with the southwestern line of Lot 19, N. 66? 53′ 10″ E. 241.32 feet to a 1/2″ rebar set in the center line of Hidden Hills Way; thence crossing Hidden Hills Way and continuing with the western line of Lot 18, S. 00? 00′ 00″ W. 100.00 feet to a 1/2″ rebar set, being the southwestern corner of Lot 18; thence with the southern line of Lot 18, N. 87? 28′ 05″ E. 382.44 feet to a 1/2″ rebar set in the western line of Lot 15 and being the southeastern corner of Lot 18; thence with the western line of Lot 15, S. 02? 59′ 25″ W. 121.33 feet to a 1/2″ rebar set in the northern line of Lot 6; thence with the northern line of Lot 6, N. 81? 34′ 40″ W. 246.66 feet to a 1/2″ rebar found; thence continuing with the northern line of Lot 6, Lot 9, and Lot 10, S. 66? 53′ 10” W. 384.54 feet to the place of BEGINNING, and containing 2.00 acres, more or less. This conveyance is subject to those restrictions for lots in Valley View Estates as set forth in Deed Book 749, at page 36. The real estate is also subject to those easements and restrictions as set forth in the above deed of record in Deed Book 808, at page 175. And being the same real estate conveyed to Paul and Doreen Martini by deed of First Community Bank, N. A., dated May 6, 2010, in Deed Book 949, at page 463. TERMS OF SALE: Ten percent (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) cash in hand on day of sale and balance upon delivery of deed. Sale subject to any and all real property taxes or assessments due or to become due, all applicable subdivision and zoning restrictions, matters of survey, compliance with environmental regulations, rights of tenants in possession, if any, and all other pertinent liens, easements, restrictions and reservations of record. The property is sold in an “as is” condition. The purchaser shall pay the excise tax on the transfer of real estate. Any personal property remaining on the premises at the time of sale shall be considered abandoned. The undersigned trustee reserves the right to reject any and all bids, the right to continue the sale by announcement on the date of the sale and the right to announce other conditions upon the sale, which announced conditions, if any, shall be in addition to or take priority over any conditions set forth herein.
