PUBLIC HEARING MEETING: THURSDAY, JANUARY 8, 2015 4:30 p.m. BLUEFIELD ZONING BOARD OF ADJUSTMENT MUNICIPAL BUILDING, 200 ROGERS STREET NOTICE OF HEARING ZONING BOARD OF ADJUSTMENT Notice is hereby given that the following has been appealed from the action of the City Manager in refusing to grant the following zoning permits: ITEM 1: Application # 10213 by O’Reilly Auto Parts store to erect a 26 ft. high post sign with sign faces being 5′ x 15′ and 4′ x 8′ total face area = 107 ft_ with 10ft. of clearance, and a wall sign being 5’3″ high x 32’3_” long 6″ thick. (Zoning: BC) Building to be used for signage on my property located at vacant lot on Bluefield Avenue between Thomas Street, Bluefield Avenue and Pearis Street, Lot 1-6, pt. lot 3, lot 16, Section No. 302,303 or County Map 17, Parcel No. 172. REASON FOR REFUSAL: Section 23-77 Business and industrial districts. (a) On- Site Signs: On-site signs in business and industrial districts shall be subject to the following regulations: (1) Wall signs. Signs shall be stationary, nonflashing, single-faced and be attached to a building. No sign shall project more than eighteen (18) inches beyond the face of a building or project above the parapet or roof line of the building face to which it is attached. The face areas of such signs shall not exceed a length of twenty – five (25) feet nor a height of six (6) feet. (2) Post signs. One (1) post sign will be permitted for each individual business conducted on the premises. Signs shall be stationary, nonflashing and must be erected with a minimum clearance of 10 feet from the surface and a maximum height of twenty (20) feet. All post signs must be constructed clear of public property lines and must not exceed one hundred (100) square feet in area per face. ITEM 2: Application # 10214 by US Cellular Corporation to erect three (3) wireless antennas that will be installed 3 locations on the penthouse of the existing building with the existing antennas. (Zoning: BC) Building to be used cellular antennas on the property located at 525 Bland Street between Federal Street, Bland Street, and Scott Street, Lot No. Pt. Lot 11, Section No. 11 or County Map 18, Parcel No. 65. REASON FOR REFUSAL: Section 23 – 49 Special exceptions: The Board of Adjustment may authorize commercial communication tower or antenna in BC Zoning. A public hearing will be held in the Board of Directors Room, the New Municipal Complex at 200 Rogers Street, Bluefield, West Virginia on Thursday, January 8th at 4:30 pm. At the time of the execution of the Deed of Trust, this property was reported to have an address of: 88 Bayley Drive, Bruceton Mills, WV 26525.

The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’ s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.

The subject property will be sold in "AS IS" condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

TERMS: $9,000.00 in cash and/or certified funds as deposit with the balance due and payable within 30 days of the day of sale.

FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.
