TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated January 7, 2005, and duly recorded in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Book No. 1032, at Page 1, Michael W. Perdue and Kathy B. Perdue did convey unto BB&T Collateral Service Corporation , Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated April 17, 2015 and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by Branch Banking and Trust Company to foreclose thereunder, will offer for sale at public auction at the front door of the Mercer County Courthouse in Princeton, West Virginia, on June 4, 2015 at 1:30 PM the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in Bluefield District, Mercer County, West Virginia, and more particularly described as follows: MICHAEL W. PERDUE, ET UX., REAL ESTATE DESCRIPTION: All of that certain lot or parcel of real estate situate, lying and being in Bluefield District, Mercer County, West Virginia, described as follows: PARCEL NO. 1: All those certain lots or parcels of real estate situate in Bluefield District (formerly Beaver Pond District), Mercer County, West Virginia, known as Lots 25 and 26, and the southern one-half (1/2) of Lot 24, all in Block 3, as shown on a map of Cumberland Heights Extension of the Cumberland Heights Addition, a copy of which said plat is recorded in the Office of the Assessor of Mercer County, West Virginia, in Mercer County, Map Book 1, at page 22, and which said lots or parcels of real estate are more particularly bounded and described as follows, to wit: BEGINNING at a point in the east line of Edgemont Drive, which said point is located N. 19? 09′ W. 645 feet from the point of intersection of the said east line with the north line of Meadow Street; thence from said point of beginning and with the said east line of Edgemont Drive N. 19? 09′ W. 125 feet to a point in said line and in the west line of said Lot 24, Block 3; thence with a line passing through said Lot 24, N. 70? 51′ E. 150 feet to a point; thence S. 19? 09′ E. 125 feet to a point; thence S. 70? 51′ W. 150 feet to the point of BEGINNING. PARCEL NO. 3: All that certain tract or parcel of land situate, lying and being near the City of Bluefield, Mercer County, West Virginia, designated as Lot 28, Section 3, and shown on the maps or plats of Cumberland Heights Extension of the Cumberland Heights Addition, of record in said Clerk’s Office in Plat Record 2, at page 100, and in the Office of the Assessor of Mercer County, West Virginia, in Map Book of Mercer County 1, at page 22, and being more particularly bounded and described as follows, to wit: BEGINNING at a point in the eastern line of Edgemont Drive, N. 19? 09′ W. 545 feet distant from the point of intersection of the eastern line of said Drive with the northern line of Meadow Street; thence along and with the eastern line of Edgemont Drive, N. 19? 09′ E. 50 feet to a point; thence N. 70? 51′ E. 150 feet to a point; thence along and with the western line of Lot No. 9, Section No. 3 of Cumberland Heights Addition, S. 19? 09′ E. 50 feet to a point; thence along and with the northern line of Lot No. 29, Section 3 of said Addition, S. 70? 51′ W. 150 feet to the point of BEGINNING. At the time of the execution of the Deed of Trust, this property was reported to have an address of: 2603 Edgemont Dr, Bluefield, WV 24701. The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. TERMS: $4,000.00 in cash and/or certified funds as deposit with the balance due and payable within 30 days of the day of sale. FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer. Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
