If you fail to do so, thereafter, judgement, upon proper hearing and trial, may be taken against you for the relief demanded in the Petition for Modification.

TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustees, by virtue of the authority vested in them by that certain Deed of Trust dated January 28, 2008, and duly recorded in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Deed of Trust Book 1132, at Page 615, Billy J. Gullion did convey unto Mike Day and Thomas S. Lilly, Trustees, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Richard A. Pill and David D. Pill as Substitute Trustees by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustees having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Mercer County Courthouse, in Princeton, West Virginia, on Wednesday, January 14, 2015, at 11:50 AM The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Princeton District, Mercer County, West Virginia, and more particularly described as follows: “The land referred to herein is situated in the State of West Virginia, County of Mercer described as follows: All of that certain lot or parcel of land situate in East River District, Mercer County, West Virginia, known and designated as Lot No. 382 of Lilly Homesites Addition to the City of Princeton, Mercer County, West Virginia, as shown by a map thereof incorporated in and recorded with a deed from J. H. Lilly Land Company, a corporation, to V. E. Helmandollar dated June 26, 1946, and recorded in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Deed Book No. 282, at Page 196. Reference is here made to said map and deed. The said lot fronts fifty (50) feet on First Street, and extends back therefrom with Lot 383 a distance 257.7 feet to Lot 394, and back an opposite side with Lot 381 a distance of 264.7 feet to Lot 378, and bordering a total of 54.45 feet on Lots 394 and 378. All of that certain lot or parcel of land situate in the City of Princeton, East River District, Mercer County, West Virginia, known and designated as Lot No. 384 of the Lilly Homesites Addition to the City of Princeton, West Virginia, as shown on a map of record in the Office of the Clerk of the County Commission of Mercer County, West Virginia. Said lot fronts 50 feet on First Street, and extends back therefrom in a straight line with Lot 382 a distance of 257.7 feet to a Lot 394, and back on the opposite side in a straight line with Lot 384 a distance of 241 feet to said Lot 394, bordering in straight line thereon 52.6 feet.” At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 205 Ritter Street, Princeton, WV 24740. AND BEING the same real estate which was conveyed to Billy J. Gullion, by Deed dated January 22, 2008, from The Bank of New York Trust Company, NA as successor to JPMorgan Chase Bank, NA, and recorded in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Deed Book 920, at Page 420. The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustees shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
