PLEASE TAKE NOTICE that a hearing will be held in the case of Greater Marion Public Service
District, et al. v. Thrasher Engineering, Inc., et al., Case Number 03-C-221, (the “Class Action”) before the
Honorable Michael Aloi on April 27, 2015 at 3:00 P.M. The hearing will be held at the Marion County
Circuit Court, 219 Adams Street, Fairmont, West Virginia 26554. All members of the Class Action are
invited to appear and be heard. The purpose of the hearing will be to determine the process by which
inflow and infiltration into the Carolina and Idamay vacuum sewage system will be remediated. Any
member of the Class Action who paid for repairs to the sewage system servicing their property is
instructed that the Court will also hear any claims for reimbursement that they may have at the hearing.
Any member of the Class Action who has paid for repairs and wishes to seek reimbursement must bring
proof of payment to the hearing or submit a claim to the Circuit Clerk prior to the hearing. Any member
of the Class Action submitting claims must also provide a copy of their proof of payment to: Michael R.
Proctor, Dinsmore & Shohl, 215 Don Knotts Blvd., Suite 310, Morgantown, WV 26501. Failure to submit
a claim for reimbursement at the referenced hearing may bar reimbursement of expenses in the future.
