NOTICE OF TRUSTEE’S SALE Pursuant to the authority vested in the undersigned J. Patrick Jones, Substitute Trustee by Notice of Substitution of Trustee which notice is of record in the Office of the Clerk of the County of Commission of Mercer West Virginia, and by Deed of Trust dated August 26, 2005, executed by Loene M. Meade to BB&T Collateral Service Corporation, Trustee, which deed of trust is of record in the Office of the Clerk of Mercer County, West Virginia, in Trust Deed Book 1053 at Page 704, the undersigned Substitute Trustee has been requested, in writing, by the beneficiary of said deed of trust to sell the real estate described below, as there has been a default under the terms and conditions of said deed of trust. Therefore, the undersigned Substitute Trustee will sell the real estate described in the Deed of Trust, at a public auction on July 17, 2015 at 2:30 p.m. to the highest bidder at the front door of the Courthouse of said County of Mercer, in Princeton, West Virginia, which real estate is more completely described as follows: A certain lot or parcel of land situate in Mercer County, West Virginia, and bounded and described as follows: BEGINNING at an iron pipe, corner on the north side of a dry branch, said corner being north 49 40′ W. 169.6 feet from a state highway right-of-way monument marked 400 plus 50, situated on the north side of the Princeton-Bluefield Road 140 feet north of the center of said road; thence with 5 new lines through the property of Verde and Bill Davis and others as follows; N. 48? 40′ W. 188.6 feet to a Oak tree; thence N. 67? 22′ E. 166.55 feet to an iron pipe; thence S. 54? E. 147.65 feet to an iron pipe on the north side of the above said dry branch; thence crossing said dry branch, S. 71? 02′ E. 210.05 feet to a stake on the property on the northerly right-of-way line of foresaid Princeton-Bluefield Road; thence S. 55? 32′ W. 19.9 feet to a point; thence leaving said right-of-way line of the aforesaid Princeton-Bluefield Road running N. 71? 02′ W. 208.7 feet to a point on the north side of the aforesaid dry branch; thence along the northerly side of said dry branch; S. 52? 15′ W. 78.87 feet to the place of BEGINNING, and containing 0.672 acres, and being a parcel laid out of the boundary of the lands of Verde Davis and Bill Davis, her husband, and others. Raymond Meade died intestate December 1, 2000, leaving Leone M. Meade the sole heir, which is of documented in the Fiduciary Records in the Office of the Clerk of the Mercer County Commission. This conveyance is made expressly subject to all pertinent restrictions, reservation and easements of record. TERMS OF SALE 1. Cash in hand paid on the day of sale. 2. The sale of the property will be made subject to all matters having priority over the deed of trust referred to herein including but not limited to any and all assessments and taxes against said property, all prior liens, encumbrances, lease, restrictions, covenants, conditions, right of ways and easements of any nature whatsoever. 3. The purchaser shall be responsible for the payment of the transfer taxes imposed by West Virginia Code ? 11-22-2. 4. The subject property will be sold in “AS IS” condition. The Substitute Trustee makes no representations and warranties of any kind or character including, but not limited to, the condition of the real estate or the title to the real estate to be conveyed. 5. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. 6. The Substitute Trustee reserves the right to adjourn the sale, for a time, or from time to time, without further notice by announcement at the time and place of the sale described above. 7. The beneficiary of the Deed of Trust and holder of the note thereby secured reserves the right to submit a bid for the property at the sale, which bid may be in the form of a credit bid. 8.
