TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated January 21, 2011, and duly recorded in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Book No. 1205, at Page 357, Eric Sherman did convey unto Vance Golden, Attorney/Golden and Amos, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated May 17, 2013 and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by JPMorgan Chase Bank, National Association to foreclose thereunder, will offer for sale at public auction at the front door of the Mercer County Courthouse in Princeton, West Virginia, on July 9, 2015 at 1:30 PM the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in Bluefield District, Mercer County, West Virginia, and more particularly described as follows: All of the following described real estate as described on a map showing the subdivision of Lot 1, Section 1010, of the City of Bluefield, Mercer County, West Virginia, which map is of record in the Office of the Clerk of the County Commission of Mercer County, West Virginia, as Microfilm Plat No. 38, and which said property is more particularly bounded and described as follows, to-wit: TRACT NO 1: “BEGINNING at a point in the south line of College Avenue at the northeast corner of Lot No. 1, Section 1010; thence with the said line of College Avenue, N. 85? 24′ E. 49.5 feet to the northwest corner of a lot conveyed by one J.B. Belcher, et ux, to Fred M. Hawley, by deed dated September 3, 1924; thence with the west line of the said Hawley Lot, S. 7? 50′ E.195.6 feet to a point in the north line of Ohio Street; thence with the said line of Ohio Street, S. 87? 54′ W. 25.3 feet to the southeast corner of Lot No. 1, Section 1010; thence with line of said Lot No. 1, N. 17? 6′ W. 199.6 feet to the point of beginning, being the western portion of Lot 2, Section 1010 of said City of Bluefield. TRACT NO. 2: “That certain parcel of real estate situate in the City of Bluefield, Mercer County, West Virginia, being a triangular strip of land a portion off the eastern side of Lot “K” and a portion off Lot “A”, as shown on the City Map of Bluefield, the said Lots “A” and “K” being a portion of Lot No. 1, Section 1010, as shown on a subdivision Map, and which said parcel is more particularly bounded and described as follows: “BEGINNING at a point in the southern line of College Avenue at a distance of 242.4 feet distant measured along the southern line of College Avenue from the point of Intersection of the said southern line of College Avenue with the Western line of Reid Avenue, said point of beginning being the northwest corner of Lot No. 2, Section 1010, as shown on the City Map of Bluefield, West Virginia; thence from said beginning point and along and with the Western line of Lot No. 2, Section 1010, S. 17? 06′ E. 199.6 feet to a point in the northern line of Ohio Street at the southwest corner of Lot No. 2, Section 1010, thence along and with the northern line of Ohio Street, S. 87? 54′ W. 46.2 feet to an iron pipe; thence N. 3? 43′ W. 193.1 feet to the point of BEGINNING.” Tax Map 37, Parcel 0249 At the time of the execution of the Deed of Trust, this property was reported to have an address of: 1401 College Avenue, Bluefield, WV 24701 aka 1403 College Avenue, Bluefield, WV 24701-3839. The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. TERMS: $8,000.00 in cash and/or certified funds as deposit with the balance due and payable within 30 days of the day of sale. FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer. Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale.
