NOTICE OF TRUSTEE’S FORECLOSURE SALE ON VALUABLE RESIDENTIAL REAL ESTATE Notice is hereby given that by virtue of that certain Deed of Trust dated May 11, 2011, from Presley United, LLC, a West Virginia limited liability corporation, to Karen Wimmer and A. G. Hill, Trustees, of record in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Trust Deed Book 1210, at page 483, and re-recorded in said Clerk’s Office in Trust Deed Book 1213, at page 213, the Note therein secured being in default, and the undersigned having been appointed Substitute Trustee, pursuant to a Substitution of Trustee dated July 2, 2015, and of record in said Clerk’s Office in Trust Deed Book 1298, at page 634, the undersigned Substitute Trustee, at the request of the Note holder, will offer for sale and sell at public auction on AUGUST 12, 2015, at 9:30 o’clock a.m. at the Front Door of the Mercer County Courthouse (being the North Walker side), at Princeton, Mercer County, West Virginia, the following described real estate, to-wit: “All that certain tract or parcel of real estate, together with the improvements thereon and easements and appurtenances thereunto belonging, situate in the City of Bluefield, Mercer County, West Virginia, known as Lot 13, Section 1306 (formerly Section H), of Cumberland Heights Addition, and which property is more particularly bounded and described as follows: “BEGINNING at a point in the western line of Fairfield Avenue S. 37? 17′ E. 870 feet distant from the point of intersection of the western line of Fairfield Avenue with the southern line of Cumberland Boulevard, said point of beginning being also the southeast corner of Lot No. 12, Section ‘H’, as shown on a revised plat of said Section ‘H’ of Cumberland Heights, Inc.; thence from said point of beginning and along the western line of Fairfield Avenue, S. 37? 17′ E. 80 feet to a point; thence S. 63? 16′ W. 189 feet to a point in the eastern line of the Montvale Addition; thence along the said eastern line of Montvale Addition, N. 37? 23′ W. 45.27 feet to a point at the southwest corner of said Lot No. 12, Section ‘H’; thence along the southern line of said Lot No. 12, N. 52? 43′ E. 185.76 feet to the point of BEGINNING, and being Lot No. 13, Section ‘H’, as shown upon the revised plat of said Section ‘H’ of Cumberland Heights, Inc.” At the time of the execution of the Deed of Trust, this property was reported to have an address of 2432 Fairfield Avenue, Bluefield, West Virginia 24701. Said real estate will be sold by said Trustee in “AS IS” condition with no covenants of warranty and subject to all taxes now due or to become due on said property, all liens, out conveyances, matters of survey, leases, covenants, restrictions, easements, rights-of-way, compliance with environmental regulations, rights of tenants in possession, if any, governmental assessments, and any other matters of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances including, without limitation, liens for real estate taxes, sanitary and sewer charges. The successful bidder will assume the risk of all loss or damage to the real estate and any improvements thereon after the sale and be responsible for all costs of the conveyance, including, but not limited to, any examination of title, preparation of the deed, grantor’s tax, and recording fees. IN THE EVENT THERE ARE FEDERAL TAX LIENS AGAINST THE PROPERTY, THE UNITED STATES WOULD HAVE THE RIGHT TO REDEEM THE PROPERTY WITHIN 120 DAYS FROM THE DATE OF SUCH SALE OR THE PERIOD ALLOWABLE FOR REDEMPTION UNDER LOCAL LAW, WHICHEVER IS LONGER. The terms of the Sale shall be cash in hand on the day of sale (or such other arrangement as may be satisfactory to the Trustee and holder of the Note). Said real estate will be sold by said Trustee in “AS IS” condition, subject to all taxes now due or to become due on said property, all liens, out conveyances, matters of survey, compliance with environmental regulations, rights of tenants in possession, if any, and other matters of record in said Clerk’s Office affecting the title to said property. The purchaser is to pay the excise tax on the privilege of transferring said real estate. The Trustee reserves the right to continue the Sale or to adjourn same for a time, or from time to time, without further Notice by announcement at the time and place of said Sale hereinabove set forth. THE PURCHASER, UPON PAYMENT OF THE PURCHASE PRICE IN FULL, SHALL RECEIVE FROM THE HEREINABOVE NAMED SUBSTITUTE TRUSTEE, A DEED CONVEYING THE HEREINABOVE DESCRIBED PROPERTY, WITHOUT ANY COVENANT OR WARRANTY, EITHER EXPRESS OR IMPLIED, AND SUBJECT TO THE MATTERS HEREINABOVE SET FORTH. Notice is also given that any personal property and/or belongings remaining at the property after the Foreclosure Sale will be deemed to constitute abandoned property and will be disposed of accordingly.
