NOTICE OF TRUSTEE’S SALE

NOTICE OF TRUSTEE’S SALE and Notice of the Beneficiary/Servicer’s election to sell that property secured by that certain Deed of Trust dated March 13, 2009, executed by Kelly R. Laffey to Travis R. Fitzwater, Trustee, of record in the Office of the Clerk of the County Commission of Monongalia County, West Virginia, in Book 1682, at Page 752, which Deed of Trust was assigned by Mortgage Electronic Registration Systems, Inc. to The Huntington National Bank by ASSIGNMENT dated June 8, 2015, of record in the Clerk’s Office in Book 125, at Page 653. Hereford & Riccardi, PLLC was appointed as Trustee by APPOINTMENT OF SUCCESSOR TRUSTEE dated July 22, 2015, of record in the Clerk’s Office in Book 2073, at Page 785. The borrower defaulted under the Note and Deed of Trust and the Trustee has been instructed to foreclose under the Deed of Trust. Accordingly, the Trustee will sell the following described property to the highest bidder at the front door of the Courthouse of Monongalia County, in Morgantown, West Virginia, on:

THURSDAY, AUGUST 20, 2015, AT 1:10 O’CLOCK P.M.

All of those certain lots or parcels of real estate, together with the improvements thereon and appurtenances thereunto belonging, situate in Morgan District, Monongalia County, West Virginia, being more particularly bounded and described as follows:

Parcel No 1: All of Unit 16 of Dorsey Lane Townhouses as laid down and designated upon a plat thereof, of record in the Office of the Clerk of the County Commission of Monongalia County, West Virginia, in Map Cabinet 3, Envelope 67A.

Parcel No. 2: That certain tract or parcel of real estate adjoining Unit 16, further described as follows: Beginning at a point which designates the northeastern corner of Unit 16 as laid down and designated on the official sales map or plat of Dorsey Lane Townhouses, and running with an out boundary of the parcel or tract of which the parcel herein described is part, N. 40° 01′ 52" W. 29.03 feet to an iron pin in an outline of said larger parcel; thence S. 67° 58′ W. 58.93 feet to a point in said outline a corner to Unit 15 as laid down on the aforesaid plat of Dorsey Lane Townhouses; thence with the line of Unit 15, S. 22° 10′ E. 28.50 feet to a point on line of said Unit 15; thence S. 15° 34′ E. 10 feet to a point on line of said Unit 15; thence N. 74° 06′ E. 5 feet to a point designating the southwestern corner to Unit 16 as laid down on the aforesaid Dorsey Lane Townhouses plat; thence N. 15° 54′ W. 17.89 feet to a point; thence N. 74° 06′ E. 62.10 feet to the point and place of beginning, and being an unnumbered tract adjoining Unit 16.

This is the same property conveyed unto Kelly R. Laffey by deed dated March 13, 2009, of record in the Clerk’s Office in Book 1381, at Page 374.

TERMS OF SALE:

1) The property will be conveyed in an "AS IS" physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.
2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code ยง 11-22-2.
3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.
4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.
5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate the property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
6) The total purchase price is payable to the Trustee by cashier’s check, cash or the equivalent within thirty (30) days of the date of sale, with ten percent (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of the total purchase price payable to the Trustee at sale by cashier’s check, cash or the equivalent.
