COMMISSION ORDER

On July 31, 2015, Walls Sanitation, Inc. filed an application for the transfer and assignment of P.S.C. M.C. Certificate Nos. F-7345 and F-7393 and P.S.C. M.C. Permit No. H-10624 to RGL, Inc., dba Mountain State Waste, authorizing —

P.S.C. M.C. Certificate No. F-7345 –

to operate as a common carrier by motor vehicle in the transportation of solid waste from the following points and places in Monongalia and Wetzel Counties the transportation of solid waste from those points and places in Monongalia County that are located within a radius of eight (8) miles of the intersection between Monongalia County Routes 37/5 and 41, subject to the following exclusions. (a) excluding the transportation of solid waste from those points and places in Monongalia County that are located to the east and south of the Monongahela River; (b) further excluding the transportation of solid waste from those points and places in Monongalia County that are located within the corporate limits of the Towns of Blacksville and Granville and the City of Westover; (c) further excluding the transportation of solid waste from those points and places in Monongalia County, that are located within a radius of one (1) mile of any point or points along one or more of the following routes or route segments: W.Va. Route 100, and Monongalia County Routes 24, 26, 28/1, 29/3, 35/1, 37/5, and 51, and that segment of Monongalia County Route 37 that is located to the north of its intersection with Monongalia County Route 26; and (d) further excluding the transportation of solid waste from those points and places in Monongalia County that are located between Monongalia County Route 45 and the Monongahela River; (2) notwithstanding the exclusions set forth in the foregoing paragraph, the transportation of solid waste in commercial service under Walls’ container system from those points and places in Monongalia County that are located within a radius of 10.5 miles of the intersection between Monongalia County Routes 27 and 29, subject to the following exclusions: (a) excluding the transportation of solid waste from those points and places in Monongalia County that are located within the territory enclosed by the southernmost quadrant of the circular area defined by such intersection and such radius, said quadrant being bounded on one side by a line running S. 45° W. from said intersection and on the other side by a line running S. 45 E. from that intersection, and (b) further excluding the transportation of solid waste from ail public elementary school facilities in Monongalia County that are located within a radius of 1.5 miles of the intersection between W.Va. Route 7 and Monongalia County Route 37, which language, as of the date of the issuance of this certificate, excludes only Core Elementary School; and (3) the transportation of solid waste from those points an places in Wetzel County that are located to the east of 80° 41′ West longitude (said longitudinal line running through or next to the intersection between W.Va. Route 7 and Wetzel County Route 7/20), subject to the following exclusions: (a) excluding those points and places in Wetzel County that are located to the south of 39° 35′ North latitude (said latitudinal line running just south of the intersection between Wetzel County Routes 19 and 19/1); (b) further excluding the transportation of solid waste from those points and places in Wetzel County that are located within a radius of five (5) miles of the intersection between Wetzel Count) Routes 1/7 and 89; and (c) further excluding the transportation of solid waste from those points and places in Wetzel County that are located within a radius of one (1) mile of one or more of the following routes: Wetzel County Routes 15, 19, and 40– to places of disposal.

authorizing operation as a common carrier by motor vehicle in the transportation of solid waste from those points and places in Monongalia County that are located within a radius of three (3) miles of the point at which Monongalia County Route 39 touches the Pennsylvania-West Virginia state line, subject to the following exclusions — (a) excluding the transportation of solid waste from those points and places in Monongalia County that are located within a radius of 0.3 mile of any point or points along W. Va. Route 7, (b) further excluding the transportation of solid waste from those points and places in Monongalia County that are located to the south of W. Va. Route 7, (e) further excluding the transportation of solid waste from those points and places in Monongalia County that are located within a radius of one (1) mile of the intersection between W. Va. Route 7 and Monongalia County Route 37, (d) further excluding the transportation of solid waste from those points and places in Monongalia County that are located within a radius of five (5) miles of the intersection between W. Va. Routes 7 and 705, (e) further excluding the transportation of solid waste from those points and places in Monongalia County that are located to the east of U. S. Route 19, and (f) further excluding the transportation of solid waste in commercial service through the use 2 of rolloff containers from points and places in Monongalia County — to places of disposal.

to operate one motor vehicle as a contract carrier in the transportation of trash, rubbish and garbage within the Town of Littleton, Wetzel County, under contract with the Town of Littleton.

IT IS THEREFORE ORDERED that Walls Sanitation, Inc. give notice of the filing of the as provided Monongalia application, by publishing a copy of this order once in a qualified newspaper in W. Va. Code ยง59-3-1 et seq. published and of general circulation in and Wetzel Counties making due return to this Commission of proper certification of publication immediately after publication. Anyone desiring to protest or intervene should file a written protest or notice of intervention within ten days following the date of this publication unless otherwise modified by Commission order. If no protests are received, the Commission may waive formal hearing and render its decision on the application based on the evidence submitted with the application and the Commission’s review thereof. Requests to intervene must comply with the Commission’s rules on intervention set forth in the Commission’s Rules of Practice and Procedure.
