NOTICE OF TRUSTEE’S SALE

Under authority of that certain Deed of Trust dated May 13, 2011, from Jennifer D. Miller and Benjamin C. Miller to Daniel Oliver, Trustee, of record in the office of the Clerk of the County Commission of Monongalia County, West Virginia in Trust Deed Book No. 1814, at page 284, securing a promissory note in the principal amount of $102,061.82, payable to Vanderbilt Mortgage and Finance, Inc., and default having been made under the promissory note secured by the aforesaid Deed of Trust and sale requested by Vanderbilt Mortgage and Finance, Inc., the undersigned Substitute Trustee will offer for sale at the front door of the Monongalia County Courthouse in Morgantown, West Virginia on September 29, 2015 at 10:00 a.m., subject to all reservations, exceptions, easements and other matters which appear of record, and subject to all unpaid taxes, if any, all of the following parcels or tracts of real estate, together with the improvements thereon, and appurtenances thereunto belonging, being in Grant District, Monongalia County, West Virginia, and being more particularly bounded and described as follows:
Parcel One:
Beginning at a one-half inch iron pin(fd) at the eastern corner of a 0.468 acre parcel now owned by Miller (DB 1386-525) and on a line of Livengood, Nevera, Nevera and Rice (WB 129-470), thence with a line along Livengood et al S. 69° 17′ 21" E. 73.00 feet to a 5/8" iron pin (set), said pin being a new corner with Gump (DB 1384-519), thence with a line across Gump S. 37° 19′ 58" W. 157.45 feet to a 5/" iron pin (set), said iron pin being on a line of Paugh (DB 1201-481), thence with a line along Paugh N. 48° 00′ 00" W. 93.00 feet to a 1/2" iron pin (fd), said iron pin being the southern corner of the 0.468 acre parcel owned by Miller (DB 1386-525), thence with a line along Miller N. 47° 19′ 52" E. 130.99 feet to a 1/2" iron pin, the place of beginning, containing 0.266 acre, more or less.

This conveyance is specifically made subject to all easements and rights of way shown upon a plat attached hereto including a 15′ Right of Way.
Being the same property conveyed from Mark A. Gump and Julie L. Gump, husband and wife, to Benjamin C. Miller and Jennifer D. Miller by Deed dated May 4, 2011, of record in the aforesaid Clerk’s office in Deed Book No. 1436, at page 506.

Parcel Two:
Beginning at a 1/2" iron pin (set), being an original common corner to the lands of Doris A. Coombs (from which lands the parcel herein described is a part of) and the lands of Josephine Livengood, et al; thence with a new division line through the lands of Coombs, South 47 degrees 19 minutes 52 seconds West (S. 47° 19′ 52" W), a distance of 130.99′ feet (passing through an 18" pine tree on line at a distance of 98.47′ feet) to a 1/2" iron pin (set), standing in an original common line of Coombs and the lands of Gerald Paugh (Lot #10 of the River’s Bend Subdivision II); thence with the original common line of Coombs, Paugh and the lands of Eric & Stephanie Lindsey (Lot #1 of the River’s Bend Subdivision), North 48 degrees 00 minutes 00 seconds West (N. 48° 00′ 00" W.) a distance of 164.68′ feet (passing through an iron nail found on-line at a distance of 127.32′ feet) to a point inside the southerly right-of-way limits of W.V. Route #4C; thence with the original northwesterly line of Coombs, North 53 degrees 45 minutes 00 seconds East (N. 53° 45′ 00" E.) a distance of 131.88′ feet to a point, being an original common corner to Coombs and Livengood; thence with an original common line of Coombs and Livengood, South 48 degrees 30 minutes 00 seconds East (S. 48° 30′ 00" E.), a distance of 150.00′ feet (passing through a 2" iron pipe found on line at a distance of 10.33′ feet) to the point of beginning, and containing 0.468 acres, as shown on a plat prepared October 8, 2008 by Blue Mountain Engineering.

Being the same property conveyed from Doris A. Coombs to Benjamin C. Miller III and Jennifer D. Miller, husband and wife, by Deed dated May 5, 2009, of record in the aforesaid Clerk’s office in Deed Book No. 1386, at page 525.

Terms of the sale: cash on date of sale.
