Description of Property:
All of the following described lot or parcel of real estate designated as Lot 2, in Block I, North Morgantown Addition, Fourth Ward, City of Morgantown, Morgan District, Monongalia County, West Virginia, and more particularly described as follows:

Beginning at a 5/8 inch iron pin on the Northern right of-way limits of Melrose Street, corner to Lots Nos, 3 and 4 in said Block I; thence with the northern right-of-way limits of Melrose Street, South 47° 35′ West 40.00 feet t to a point, corner to Lots Nos. 2 and 3, the POINT OF BEGINNING; thence with a line of Lot No. 2, North 42 ° 25′ West 120.00 feet to a point in the Southern right-of-way limits of said Alley E, corner to Lots Nos, 2 and 3; thence with the Southern right-of-way limits of said Alley E, being 15 feet in width, South 47° 35′ West 40.00 feet to a ½ inch iron pipe, found, corner to Lots Nos. 1 and 2; thence with the line of Lot No. 1, South 42° 25′ East 120.00 feet to the point in the Northern right of way limits of Melrose Street, corner to Lots Nos, 1 and 2, thence with the Northern right-of-way limits of Melrose Street, South 47° 35′ West 40.00 feet to a point and place of beginning, containing 4,800 square feet, and being all of Lot No. 2, as shown on a plat of survey prepared by Paul D. Harbert, L.L.S. No, 862, dated October, 1992, and recorded in the office of the Clerk of the County Comission of Monongalia County, West Virginia, in Deed Book 1056, at Page 337.

This being the same property conveyed to AMH Properties, LLC, a West Virginia limited liability company, by deed of Mountain Oak Properties, a Limited Liability Company, a West Virginia limited liability company, dated the 12th day of March, 2007 and recorded in the Office of the Clerk of the County Commission of Monongalia County, West Virginia, in Deed Book 1337, at Page 41.

Pursuant to the terms and provisions of that certain Order of February 18, 2015, entered in the Circuit Court of Monongalia County, West Virginia, in Civil Action No. 10-C-718 (Tucker), styled First United Bank & Trust vs AMH Properties, LLC, et al, Stephen K. Shuman, Esquire, was appointed Special Commissioner to sell the above-described tract or parcel of real estate at public sale at the front door of the Monongalia County Courthouse, located on High Street, Morgantown, West Virginia, to the highest bidder.

Therefore, the undersigned Special Commissioner, Stephen K. Shuman, Esquire, will offer for sale at public auction to be held at 10:00 o’clock a.m. on the 24th day of September, 2015 at the front door of the Monongalia County Courthouse, High Street, Morgantown, West Virginia.
The sale of the property will be "AS IS" condition.
The sale will not include any personal property.
The undersigned Special Commissioner will convey the property by deed containing covenants of Special Warranty.

The purchaser of the aforesaid parcel will be required to execute a memorandum of sale after the close of the Special Commissioner’s Sale.

The successful bidder for the parcel will be required to pay to the Special Commissioner 15{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c} of the successful bid at the close of the sale with the balance of the purchase price payable within 20 dates of the date of the sale.

All funds will be required to be either certified or cashier’s checks or by wire transfer.
