NOTICE OF APPLICATION FOR DISBURSEMENT OF ROYALTIES TO THE DEPARTMENT OF MINES, MINERALS & ENERGY DIVISION OF GAS AND OIL Docket Number VGOB 09-0217-2468-01 Unit Number A-37 Oakwood Coalbed Methane Gas Field 1 To: All persons, their known and unknown heirs, executors, administrators, devisees, assigns and successors, owning an interest in the gas, oil, coal or minerals as identified in the pooling order for Coalbed Methane Well Number A-37 located in Oakwood Coal bed Methane Gas Field 1 located in the Garden District, Patterson Quadrangle of Buchanan County, Virginia filed before the Virginia Division of Gas and Oil Board. NOTICE IS HEREBY GIVEN that ARP Mountaineer Production, LLC, Park Place Corporate Office Center, 1000 Commerce Drive 4th Floor, Pittsburgh, PA 15275, is requesting that the Virginia Gas and Oil Board (hereinafter “Board”) to issue an order disbursement of the principal and accrued interest, less escrow account fees, held in escrow, along with all future royalties attributable to the drilling unit, to each gas claimant identified in the pooling order pursuant to Virginia Code ? 45.1 -361.2 in regard to the above-referenced well number, unit, and docket number. NOTICE IS FURTHER GIVEN that this cause has been submitted to the Department of Mines, Minerals & Energy Division of Gas and Oil Board for release of funds held in escrow or suspense because of conflicting claims to coalbed methane gas.
