NOTICE OF TRUSTEE’S SALE Pursuant to the authority vested in the undersigned J. Patrick Jones, Substitute Trustee by Notice of Substitution of Trustee which notice is of record in the Office of the Clerk of the County of Commission of Mercer West Virginia, and by Deed of Trust dated August 26, 2013, executed by James E. Williams II to BB& T Collateral Service Corporation, Trustee, which deed of trust is of record in the Office of the Clerk of Mercer County, West Virginia, in Trust Deed Book 1263 at Page 356, the undersigned Substitute Trustee has been requested, in writing, by the beneficiary of said deed of trust to sell the real estate described below, as there has been a default under the terms and conditions of said deed of trust. Therefore, the undersigned Substitute Trustee will sell the real estate described in the Deed of Trust, at a public auction on October 16, 2015 at 2:30 p.m. to the highest bidder at the front door of the Courthouse of said County of Mercer, in Princeton, West Virginia, which real estate is more completely described as follows: PARCEL TWO: “All that certain or parcel of real estate situate near the base of Jesse’s Knob of East River Mountain, in the East River District of Mercer County, West Virginia,” which tract or parcel of real estate is further described as follows: “Tract No.2, as shown on a map bearing the legend “Map Showing the Subdivision of 51.52 acres of the William H. Burruss, Jr., Property Described in Deed Book 505, at Page 780, East River District, Mercer County, W.Va., 5-75, Scale 1″ = 400′, Ronald D. Fink, L.S.,’ being described as follows: BEGINNING at an iron pin set in a large poplar stump, said iron pin being the southern corner of Tract 1, a 32.50-acre tract of the subdivision of the William H. Burruss property, and with the southern line of Tract 1, N 65? 0 19′ E. 512.55 feet to an iron pin, said being S. 80? 0 E. 3.65 feet from a 32-inch chestnut oak; thence S. 15? 0 40′ E. 663.86 feet to an iron pin set in a poplar stump about a large rock, called for in the Burruss deed; thence S. 20 0 22′ E. 285.50 feet to an iron pin; thence S. 12? 0 03′ E. 177.23 feet to a 50- inch white oak, corner to the William H. J. Handzel property and the Hilda Brown property; thence with the Handzelline, N. 76? 0 26′ W. 133.04 feet to two Iynns, corner to the Hilda Brown property and the Handzel property; thence with Brown, N 6? 0 53′ W. 1297.55 feet to an iron pin set in a rock fence, said iron pin being on the south side of a farm road crossing the Burruss property; thence with Brown and a rock fence, N. 25? 0 12′ W. 1445.65 feet to the BEGINNING, containing 19.02 acres, more or less.” TERMS OF SALE 1. Cash in hand paid on the day of sale. 2. The sale of the property will be made subject to all matters having priority over the deed of trust referred to herein including but not limited to any and all assessments and taxes against said property, all prior liens, encumbrances, lease, restrictions, covenants, conditions, rights of way and easements of any nature whatsoever. 3. The purchaser shall be responsible for the payment of the transfer taxes imposed by West Virginia Code ? 11-22-2. 4. The subject property will be sold in “AS IS” condition. The Substitute Trustee makes no representations and warranties of any kind or character including, but not limited to, the condition of the real estate or the title to the real estateto be conveyed. 5. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. 6. The Substitute Trustee reserves the right to adjourn the sale, for a time, or from time to time, without further notice by announcementat the time and place of the sale described above. 7. The beneficiary of the Deed of Trust and holder of the note thereby secured reserves the right to submit a bid for the property at the sale, which bid may be in the form of a credit bid. 8.
