NOTICE OF TRUSTEES’ FORECLOSURE SALE ON VALUABLE RESIDENTIAL REAL ESTATE Property Address: 2637 Clovis Street, Bluefield, West Virginia 24701 Upon notification by the holder of a Note secured by the Deed of Trust described below of a default and having been requested to institute these proceedings, and by virtue of the authority vested in us under that certain Deed of Trust dated the 24th day of September, 2004, executed by Richard H. McPherson and Jacklyn H. McPherson unto Karen Wimmer and Greg Morris, and which said Deed of Trust is of record in the Office of the Clerk of the County Commission of Mercer County, West Virginia in Trust Deed Book 1022 at page 147, which said Deed of Trust secured New Peoples Bank, Inc. A Substitute Trustee was recorded for the said Deed of Trust substituting Thomas S. Lilly and Phillip B. Ball, as Trustees, which said Substitution of Trustees is recorded in the said Clerk’s Office in Book 1181 at page 729. The property was further secured by, and default has also occurred under Deed of Trust dated November 16, 2007, executed by Richard H. McPherson and Jacklyn H. McPherson unto Karen Wimmer and Greg Morris, and which said Deed of Trust is recorded in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Trust Deed Book 1127, at Page 729, which said Deed of Trust secured New Peoples Bank, Inc. A Substitute Trustee was recorded for the said Deed of Trust substituting Thomas S. Lilly and Phillip B. Ball, as Trustees, which said Substitution of Trustees is recorded in the said Clerk’s Office in Book 1280 at page 107. ON THE 30th DAY OF NOVEMBER, 2015 AT 10:00 A.M., at the front door of the Mercer County Court House at Princeton, Mercer County, West Virginia, offer for sale at public auction to the highest bidder, the following residential property, to-wit: “that certain tract or parcel of real estate located and being within the City of Bluefield, County of Mercer, State of West Virginia, and being Lot 22, Section 975, in said city, and being a part of what was formerly known as Lot 3, Section B of the Springdale Acre Farms Addition to said city, which lot or parcel of real estate is more particularly bounded and described as follows: “BEGINNING at the point of intersection of the east line of Clovis Street and the north line of Longview Avenue; thence along and with the east line of Clovis Street N. 31? 40′ W. 66.2 feet to a point, the southwest corner Lot 21, in said Section; thence along and with the southern line of Lot 21, N. 58? 20′ E. 160 feet to a point, the southeast corner of said Lot 21, and in the western line of Lot 23 in said Section; thence with the western line of Lot 23, S. 31? 40′ E. 66.2 feet to a point in the northern line of Longview Avenue; thence along and with the northern line of Longview Avenue S. 58? 20′ W. 160 feet to the point of BEGINNING. And being the same property conveyed unto Richard H. McPherson and Jacklyn H. McPherson by deed of Dreama F. Mitchell, dated September 14, 2004, and of record in the Office of the Clerk of the County Commission of Mercer County, West Virginia in Deed Book 874 at page 66. This conveyance is made expressly subject to all pertinent restrictions, reservations, and easements of record. The terms of the sale shall be cash in hand on the day of sale (or such other arrangement as may be satisfactory to Trustee and holder of the Note) and said property is being sold in “as is” condition. Said sale is subject to all taxes now due or to become due on said property, all liens, including but not limited to sewer liens and restrictions, easements or other matters of record in said Clerk’s Office affecting the title to said property. The purchaser is to pay the excise tax on the privilege of transferring said real estate. In the event there are federal tax liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale, or the period allowable for redemption under local law, whichever is longer. Notice is also given that any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
