NOTICE OF TRUSTEE’S SALE Pursuant to the authority vested in the undersigned J. Patrick Jones, Substitute Trustee by Notice of Substitution of Trustee which notice is of record in the Office of the Clerk of the County of Commission of Mercer West Virginia, and by Deed of Trust dated July 25, 1997, executed by Barbara B. Hawkins to Dewey Russell and John Bowling, Trustees, which deed of trust is of record in the Office of the Clerk of Mercer County, West Virginia, in Trust Deed Book 785 at Page 601, the undersigned Substitute Trustee has been requested, in writing, by the beneficiary of said deed of trust to sell the real estate described below, as there has been a default under the terms and conditions of said deed of trust. Therefore, the undersigned Substitute Trustee will sell the real estate described in the Deed of Trust, at a public auction on December 4, 2015 at 2:30 p.m. to the highest bidder at the front door of the Courthouse of said County of Mercer, in Princeton, West Virginia, which real estate is more completely described as follows: The following described property situate in East River District, Mercer County, West Virginia, known as Lot 3-E of the Woodcrest Addition, a map of said Woodcrest Addition is recorded in the Office of the Clerk of the County Commission, Mercer County, West Virginia, with a deed from Doyle & Doyle, Inc., a corporation, to Edward B. Marino and wife, the said Lot herein conveyed not being shown thereon; however, the northeastern corner of the same, as it bounds Greenview Drive, is shown upon said Map as the southeastern corner of Lot 2-E; the property herein conveyed is, however, shown upon a Map attached with the Deed from Doyle & Doyle, Inc., a corporation, to the parties to this Deed, which Deed is dated the 18th day of January, 1974, of record in said Clerk’s Office in Deed Book 505, at page 644, said Map being recorded as Microfilm Plat Record No. 5419, and which said Map is entitled: “Plat of Survey Showing Revision of Lots 3-E through 8-E, Woodcrest Addition, located near Princeton, East River District, Mercer County, West Virginia, surveyed by Charles L. Harvey, Jr.; Princeton, West Virginia, on January 16, 1974. Sale 1” = 50′. Said Lot hereby conveyed is more specifically described as follows: BEGINNING at a point on the western boundary of Greenview Drive, which point is the common boundary line between Lot 3-E and Lot 2-E as it bounds Greenview Drive; thence from such beginning point along Greenview Drive, S. 08? 24′ W. 41.48 feet to a hub and S. 01? 36′ E. 62.85 feet to a hub set in a driveway serving other lots; thence leaving Greenview Drive and along and with the said driveway, N. 86? 38′ W. 60.00 feet to a hub; thence leaving said driveway, N. 03? 47′ W., 104.92 feet along the boundary line of Lot 4-E to an iron pin set in the boundary line of Lot 2-E; thence leaving Lot 4-E and along and with the boundary of Lot 2E S. 86? 39′ E. 75.00 feet to the point of BEGINNING. The foregoing conveyance is subject to Protective Covenants and Reservations for said Addition, recorded in said Clerk’s Office in Deed Book 471, at page 214. There is reserved from the operation of this deed and easement for utilities, power lines and sewer lines which are existing upon the property, as well as those referred to in the Protective Covenants and Reservations. TERMS OF SALE 1. Cash in hand paid on the day of sale. 2. The sale of the property will be made subject to all matters having priority over the deed of trust referred to herein including but not limited to any and all assessments and taxes against said property, all prior liens, encumbrances, lease, restrictions, covenants, conditions, rights of way and easements of any nature whatsoever. 3. The purchaser shall be responsible for the payment of the transfer taxes imposed by West Virginia Code ? 11-22-2. 4. The subject property will be sold in “AS IS” condition. The Substitute Trustee makes no representations and warranties of any kind or character including, but not limited to, the condition of the real estate or the title to the real estate to be conveyed. 5. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. 6. The Substitute Trustee reserves the right to adjourn the sale, for a time, or from time to time, without further notice by announcement at the time and place of the sale described above. 7. The beneficiary of the Deed of Trust and holder of the note thereby secured reserves the right to submit a bid for the property at the sale, which bid may be in the form of a credit bid. 8.
