TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated June 8, 2004, and duly recorded in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Book No. 1010, at Page 211, Ernest L. Yates did convey unto Harold Brewster, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated August 28, 2015 and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by U.S. Bank National Association to foreclose thereunder, will offer for sale at public auction at the front door of the Mercer County Courthouse in Princeton, West Virginia, on December 3, 2015 at 1:30 PM the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in Rock District, Mercer County, West Virginia, and more particularly described as follows: All of that certain tract or parcel of real estate designated as Parcel “A” on “PLAT SHOWING PROPERTY DENOTED PARCEL ‘A’ & PARCEL ‘B’ LYING ON THE WATERS OF BLUESTONE RIVER OF NEW RIVER ROCK DISTRICT – MERCER COUNTY ONE & ONE-HALF MILES SOUTHEAST OF LASHMEET – WEST VIRGINIA SCALE 1″= 80′ DECEMBER 6, 1999 SHIELDS ENGINEERING CO. LLC”, said plat to be recorded simultaneously herewith and made a part hereof and being more particularly bounded and described as follows: BEGINNING at a 1/2 inch rebar set at the base of a 12 inch White Pine and in the southern right-of-way line of Mercer County Route Number 12/4 and at the northwest corner of Pamela L. Boehning and being a common corner to James P. Blevins; thence with the western and southern lines of said Boehning and being common lines to said Blevins the following three calls: S. 06? 12′ 05″ W. 239.63 feet to a tall 1 1/4 iron pipe found; thence S. 74? 24′ 45″ E. 180.52 feet to a 1/2 inch rebar set; thence S. 21? 14′ 35″ W. 80.68 feet to a 1/2 inch rebar set; thence through the lands of Blevins, the following four calls: S. 67? 06′ 25″ W. 257.95 feet to a 1/2 inch rebar set; thence N. 24? 30′ 10″ W. 254.48 feet to a 1/2 inch rebar set; thence N. 08? 54′ 10″ E. 68.15 feet to a 1/2 inch rebar set; thence N. 12?39′ 15″ E. 213.63 feet to a 1/2 inch rebar set in the southern right-of-way line of said County Route; thence with the southern line of said County Route, S. 74? 54′ 35″ E. 173.05 feet to the point of BEGINNING, and containing 2.30 acres, more or less. And being the same property conveyed to the Grantor herein from James P. Blevins, by Deed dated the 6-7-04, and recorded in the Clerk’s Office of the Circuit Court of Mercer County, West Virginia, simultaneously herewith. At the time of the execution of the Deed of Trust, this property was reported to have an address of: 1890 Mt Olive, Rock, WV 24747 aka 1890 Mt Olive Road, Rock, WV 24747. The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. TERMS: $9,000.00 in cash and/or certified funds as deposit with the balance due and payable within 30 days of the day of sale. FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer. Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
