TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated April 3, 2009, and duly recorded in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Book No. 1163, at Page 554, Mamie E Frazier and Willard L. Green did convey unto BB&T Collateral Service Corporation, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated October 9, 2015 and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by FV-I, Inc. in Trust for Morgan Stanley Mortgage Capital Holdings LLC to foreclose thereunder, will offer for sale at public auction at the front door of the Mercer County Courthouse in Princeton, West Virginia, on December 3, 2015 at 1:30 PM the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in Beaver Pond District, Mercer County, West Virginia, and more particularly described as follows: “All of that certain lot or parcel of land situate in Beaver Pond District, Mercer County, West Virginia, and known and designated as Lot No. 3 as shown on a Map of said property entitled, ‘Plat of Survey Showing 7 lots divided from the Neil L. Hines tract described in Deed Book 534 at page 262 and located 2 miles Southwest of Princeton in Beaver Pond District, Mercer County, West Virginia Date: 8/28/76 Scale: 1″=50′ Dana Pettrey, L.L.S., Box 641 Athens, W.Va.- – – Lots 1 & 2 revised from original plat on 2/15/77 by D. P.” which Map is of record in the Office of the Clerk of the County Commission of Mercer County, West Virginia, as Microfilm Plat Record No. 6271, which said Lot No. 3 is bounded and described in a more particularly individual description as follows: BEGINNING at an Iron Pin in the Westerly corner of said Lot No. 3, being a corner to Lot No. 2 and being in the dividing line between Lots Nos. 2 and 3; thence N. 26? 32′ E. 93.33 feet to an Iron Pin, corner to Lot No. 4; thence along and with the dividing line between Lots Nos. 3 and 4, S. 50?12′ E. 102.08 feet to an Iron Pin; thence S. 27? 08′ W. 92.98 feet along and with the Powder House Hollow Road to an Iron Pin, corner to Lot No. 2; thence along and with the dividing line between Lots 2 and 3, N. 50? 16’ W. 101.04 feet to the point of BEGINNING, containing 0.21 of an acre.” And being the same property conveyed to Willard Lee Green by Quitclaim Deed dated October 20, 2008 from Alice Marie Perkins (also known as Alice Marie Green), of record in said Clerk’s Office in Deed Book 933, at Page 446. And also being the same property conveyed to Willard Lee Green and Alice Marie Green, his wife, by Deed dated February 28, 1991 from Richard L. Colvard, single of record in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Deed Book 708, at Page 445. “This Deed is specifically made subject to the Declarations of Protective Covenants, Reservations and Restrictions pertaining to Lots in Woodland Hill, Powder House Hollow, in Beaver Pond District, Mercer County, West Virginia, of record in said Clerk’s Office in Deed Book No. 546, at page 347, and the same shall be binding on the lots herein conveyed the same as though said Declaration of Protective Covenants, Reservations and Restrictions were set forth herein verbatim.” “This Deed is made subject to an Easement in favor of Appalachian Power Company for the purpose of constructing and maintaining power lines, which Easement is of record in said Clerk’s Office in Deed Book No. 475, at page 604.” At the time of the execution of the Deed of Trust, this property was reported to have an address of: 343 Glenwood Haven Road, Princeton, WV 24740. The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. TERMS: $5,000.00 in cash and/or certified funds as deposit with the balance due and payable within 30 days of the day of sale. FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer. Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
