The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated September 24, 2005, and duly recorded in the Office of the Clerk of the County Commission of Monongalia County, West Virginia, in Document No. 203157, in Book No. 1417, at Page 047 and modified in Book No. 1458, at Page 441, Brenda Williams and Charles E. Stevens did convey unto Timothy J. Manchin, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated September 30, 2015 and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by Wells Fargo Bank, N.A. to foreclose thereunder, will offer for sale at public auction at the front door of the Monongalia County Courthouse in Morgantown, West Virginia, on

All the following described parcel of real estate situate in Grant District, Monongalia County, West Virginia, and more particularly bounded and described as follows:
BEGINNING at a point standing in the centerline of West Virginia Secondary Route 43/1 (commonly called Gallus Road) and marking the southwest corner to Lot "A of the Miller lands (see plat of said Miller Lands recorded in Map Cabinet No. 3 at File 62B) as conveyed to Willard G Rowan, Sr. and Virginia R. Rowan by deed recorded in Deed Book 1170, at Page 438; thence with two lines along said route 43/1, South 49°04’37" West, 43.29 feet to a point in the centerline of said Route 43/1; thence South 45°59’32" West 147.32 feet to a point standing on the southern edge of the cartway of said Route 43/1; thence leaving Route 43/1 and with four new division lines, North 46°48’20" West (said line passing through a 1/2 inch reinforcing rod (set) standing at a distance of 32.15 feet) 135.81 feet in all to a 1/2 inch reinforcing rod (set); thence North 31°34’00" East 83.53 feet to a 1/2 inch reinforcing rod (set); thence North 45 degree 48′ 00" West 182.87 feet to a ½ inch reinforcing rod (set); thence North 43°58’10" East 155.62 feet to a 1/2 inch reinforcing rod (set), said rod standing in line of Lot "G" of said Miller lands as conveyed to John A. Galie, Jr., by deed recorded in Deed Book 1261, at Page 608 and in Deed Book 1164, at Page 459; thence with said Lots "G" and "A" South 38°29’30" East (said line passing through a 1/2 inch reinforcing rod (set) standing at distances of 12.32 feet and 328.79 feet) 348.68 feet in all to the place of beginning, containing 57,445 square feet or 1.3187 acres, more or less and as set forth on a plat of survey thereof prepared by Allan J. Witschi, P.S. No. 587, dated July 19, 2005, entitled "Plat of Survey for Charles E. Stevens & Mindi L. Wilson," a copy of which is recorded in the Office of the Clerk of the County Commission of Monongalia County, West Virginia, at Deed Book 1303, page 631, and which incorporated herein for all pertinent purposes.
At the time of the execution of the Deed of Trust, this property was reported to have an address of: 1260 Gallus Rd, Morgantown, WV 26501-7741.
The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.
The subject property will be sold in "AS IS" condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: $9,000.00 in cash and/or certified funds as deposit with the balance due and payable within 30 days of the day of sale.
FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.
Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
