NOTICE OF TRUSTEE’S SALE NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, Richard A. Pill, David D. Pill, and Amanda E. Steiner, any of whom may act, by that certain Deed of Trust dated August 1, 2003, executed by Borrower(s), Christy Carbaugh and Mark Carbaugh, to James B. Crawford, III, the Trustee of record in the office of the Clerk of the County Commission of Mercer County, West Virginia, in Book 978, at Page 68. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 421 West Cumberland, Bluefield, WV 24701. Richard A. Pill, David D. Pill, and Amanda E. Steiner were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated December 3, 2014, of record in the Clerk’s Office in Book 1294, Page 264. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Mercer County, in Princeton, West Virginia, on the following date: December 17th 2015, at 12:05 P.M. The property is described as of that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in Bluefield District, Mercer County, West Virginia, and being more particularly described as follows: All that certain lot or parcel of land, situate, lying and being in Bluefield, Mercer County, West Virginia, and more particularly bounded and described as follows, to-wit: Lot 2N on the south side of Cumberland Road, Bluefield, Mercer County, West Virginia, shown on Microplat No. 6302, and on the Assessor’s Map for the City of Bluefield on Map 39 and Parcel 290.1. BEGINNING at a tack in the southern line of Cumberland road at the northeast corner of Lot No. 1 shown on the aforesaid map; thence N 61 degrees 39′ E. 55 feet to a tack set in an oak tree at the southern line of Cumberland Road and northwest corner of Lot 3 shown on said map; thence S 28 degrees 25′ E. 160 feet to a 2 1/2 ” Diameter PVC Pipe, filled with concrete and a nail set in the center; thence through Lot 2, S 61 degrees 39′ W. 55 feet to a 2 1/2 Diameter PVC Pipe, filled with concrete and a nail set in the center; thence N 28 degrees 25′ W. 160 feet to the point of BEGINNING. And being the same real estate conveyed unto Mark Christopher Carbaugh by Deed dated August 31, 2000 from Charles R. Perdue, Jr., unmarried, which Deed is of record in said Clerk’s Office in Deed Book 823 at Page 667. THERE is excepted from this conveyance 870 square feet fronting Cumberland Road heretofore conveyed by deed of Nannie Bertie Yost, Widow, to the State Road Commission of West Virginia, dated September 1, 1966, and of record in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Deed Book 428 at page 221, for purpose of constructing a curb and sidewalk along Cumberland Road. TERMS OF SALE: 1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property. 2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code ? 11-22-1. 3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. 4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee. 5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY. 6) The total purchase price is payable to the Trustee by certified or cashiers check within thirty (30) days of the date of sale, with ten (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of the total purchase price payable to the Trustee at sale by certified or cashiers check.
