AMENDED NOTICE OF TRUSTEE SALE Pursuant to the authority vested in the undersigned by Deed of Trust dated the 25th day of June, 2012, executed by Tyler Parsley and Carla Parsley, unto Harold B. Wolfe, III, and Marc B. Lazenby, Trustees, which said Deed of Trust is of record in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Trust Deed Book 1234 at 655, and the undersigned, Harold B. Wolfe, III, have been requested to do so by the beneficiary, and default having been made under the terms and conditions of said Deed of Trust, and the provision in said Deed of Trust concerning acceleration having been compiled with by the beneficiary and present holder of the Note, said Trustee will sell at public auction at 10:00 a.m. on the 21st day of December, 2015, at the front doors of the Courthouse of Mercer County, West Virginia, the following described property, to-wit: ”the following described real estate with its appurtenances and improvements, as shown upon a map entitled, ‘Map Showing Addition to Tressie McComas Subdivision Lots 6-A, 7 and 8 and Showing Tracts to be sold by Tressie McComas to James Foley and Dale Ross located near Lashmeet, Rock District, Mercer County, West Virginia Scale 1″ = 50′, date of survey, 1-14-71′, to-wit: “BEGINNING at a point at the Northwestern intersection of the Lashmeet Road with Route 10/6; thence from such Beginning point S. 77? 08′ W. 122.36 feet along and with Route 10/6 to a point; thence still with said road S. 44? 47′ W. 95.80 feet to a point; thence leaving the said Route and through the property of Tressie McComas, N. 9? 02′ W. 194.94 feet to the Southern edge of an old road; thence leaving Tressie McComas and along and with the boundary of James Foley, N. 88? 10′ E. 161.06 feet and S. 28? 50’ W. 116.93 feet to the point of BEGINNING.” And being the same property conveyed unto Tyler Parsley and Carla Parsley from Roy W. Brown and Roy William Brown, Jr., by deed dated the 25th day of June, 2012, of record in the office of the Clerk of the County Commission of Mercer County in Deed Book 976 at Page 797. Carla Parsley conveyed her one-half interest of the property to Tyler Parsley by deed dated the 25th day of February, 2014, of record in the office of the Clerk of the County Commission of Mercer County in Deed Book 1003 at Page 104. THERE IS EXCEPTED AND RESERVED from the present conveyance the following described property by deed dated the 17th day of April, 1997, of record in the office of the Clerk of the County Commission of Mercer County in Deed Book 783 at Page 45, and more particularly bounded and described as follows: a right of way for public road purposes over, through, across and upon those certain tract(s) or parcel(s) ofland situate in Rock District, Mercer County, West Virginia, and shown and designated upon plans of the West Virginia Department of Transportation, Division of Highways, for the project hereinafter designated, a copy of which said plans is of record in the Office of the Clerk of the County Commission of the aforesaid County, which said real estate hereby conveyed is more particularly bounded and described as follows: TRACT NO.1 -TEMPORARY CONSTRUCTION EASEMENT BEGINNING at a point in the existing western noncontrolled access right of way line of Mercer County Route 6, said point being in the existing northern noncontrolled access right of way line of Mercer County 10/6, and 15 feet radially left of centerline at Station 1+25, Project S328-06-1.33, S699-STR/20-97, Rock District, Mercer County, West Virginia; thence, northwesterly, with said existing right of way line, 43 feet, more or less, to a point in the proposed western temporary construction easement line of Mercer County Route 6, said point being 58 feet radially left of centerline at Station 1+26; thence, northwesterly, with said proposed easement line, 51 feet, more or less, to a point 88 feet left of and at right angle to centerline at Station 1+67; thence, northeasterly, continuing with said proposed easement line, 47 feet, more or less, to a point in the proposed western permanent drainage easement line of Mercer County Route 6, said point being 84 feet left of and at right angle to centerline at Station 2+ 13; thence, southeasterly, with said proposed easement line, in a reverse centerline direction, 33 feet, more or less, to a point 59 feet left of and at right angle to centerline at Station 1 +92; thence, southeasterly, continuing with said proposed easement line, in a reverse centerline direction, 53 feet, more or less, to a point 33 feet left of and at right angle to centerline at Station 1+46; thence, southeasterly, continuing with said proposed easement line, 6 feet, to a point in the division line between Billy Godfrey, and Danny L. Goins, Jr., said point being 27 feet left of and at right angle to centerline at Station 1 +46; thence, southeasterly, with said division line, in a reverse centerline direction, 25 feet, more or less, to the place of beginning and containing 2,961 square feet, more or less. If the construction has been completed, the area of the above temporary construction easement reverted back to Billy Godfrey, the owner. TRACT NO.2 -PERMANENT DRAINAGE EASEMENT BEGINNING at a point in division line between Billy Godfrey and Danny L. Goins, Jr., said point being in the proposed western permanent drainage easement line of Mercer County Route 6, and 27 feet left of and at right angle to centerline at Station 1+46, Project S328-06-01.33, S699-ST/l20-97, Rock District, Mercer County, West Virginia; thence, northwesterly, with said easement line, 6 feet, to a point 33 feet left of and at right angle to centerline at Station 1 +46; thence, northwesterly, continuing with said easement line, 53 feet, more or less, to a point 59 feet left of and at right angle to centerline at Station 1 +92; thence, northwesterly, continuing with said easement line, 33 feet, more or less, to a point 84 feet left of and at right angle to centerline at Station 2+ 13; thence, northeasterly, continuing with said easement line, 16 feet, more or less, to a point in the division line between Billy Godfrey, and Danny L. Goins, Jr., said point being 77 feet left of and at right angle to centerline at Station 2+28; thence, southeasterly, with said division line, 8 feet, to a point 69 feet left of and right angle to centerline at Station 2+28; thence, southeasterly, continuing with said division line, in a reverse centerline direction, 92 feet, more or less, to the place of beginning and containing 893 square feet, more or less. It is the intention of this Notice to sell the secured property by proper description as was intended to be transferred and conveyed in the aforesaid Deed of Trust. The above described real estate is reported to have a physical address at 1139 Pocasin Fork, Rock, Mercer County, West Virginia, 24747. This sale will also be made subject to any and easements heretofore granted by predecessors in title; and subject further to any and all unpaid real property taxes and unpaid assessments, the purchaser assuming payment thereof. The owners and holders of said Note reserving the right to enter a bid at said sale and the right to reject any and all bids. The Trustee reserves the right to reject any and all bids. TERMS OF SALE: Cash in hand on the day of sale, or upon terms to be agreed upon between Trustee and successful bidder; payment for unpaid real estate taxes to be assumed by the purchaser. The Trustee does not warrant title to this property. Any sale hereunder may be adjourned from time to time without any notice other than oral proclamation at the time and place appointed for this sale or by posting of a Notice of same where legal notices are posted for this county. Should the Trustee not appear at the time appointed for the sale and there is no Notice posted of a continuance, please contact the office of the Trustee to make further inquiry.
