NOTICE OF TRUSTEE’S SALE Under authority of that certain Deed of Trust dated January 21, 1999, from David R. Compton and Rita A. Compton to Donald E. Epperly, Trustee, of record in the office of the Clerk of the County Commission of Mercer County, West Virginia in Trust Deed Book No. 825, at page 325, securing a promissory note in the principal amount of $95,868.00, payable to Signal Bank, National Association, and default having been made pursuant to the promissory note secured by the aforesaid Deed of Trust and sale requested by Vanderbilt Mortgage and Finance, Inc., as Assignee of the Deed of Trust, the undersigned Substitute Trustee will offer for sale at the front door of the Mercer County Courthouse in Princeton, West Virginia on January 6, 2016 at 10:00 a.m., subject to all reservations, exceptions, easements and other matters which appear of record and subject to all unpaid taxes, if any, a tract or parcel of land, together with the improvements thereon and appurtenances thereunto belonging, being Tract 3 of the Division of Parcels 11, 12 and 13 Tax Map 18, situated in Rock District, Mercer County, West Virginia, on the waters of Wolf Creek, and being more particularly described as follows: BEGINNING at a 1/2-inch rebar, found, on the line of Fay West, said rebar being a common corner of Tracts 2 and 3; thence leaving Tract 2 and with said West the following two (2) calls: S 43? 23′ 45″ E 300.33 feet to a 18-inch oak stump; N 68? 33′ 13″ E 383.74 feet to a set stone, found, said stone being a corner of Lowell Cline; thence leaving said West and with said Cline S 29? 31′ 33″ W 530.73 feet to a 1/2-inch rebar, found, said rebar being a common corner of Tracts 3 and 4; thence leaving said Cline and with Tract 4 the following (2) calls: N 54? 30′ 59″ W 276.43 feet to a 1/2-inch rebar, found; S 22? 55′ 38″ W 376.91 feet to a 1/2-inch rebar, found, said rebar being a common corner of Tracts 3, 4 and 5; thence leaving Tract 4 and with Tract 5 the following two (2) calls: with a curve to the right having a radius of 38.42 feet, an arc distance of 95.20 feet, a chord bearing of N 86? 05′ 10″ W and a chord distance of 72.65 feet to a 1/2-inch rebar, found; N 15? 05′ 57″ W 168.11 feet to a 1/2-inch rebar, found, on the eastern right-of-way line of Secondary Route 5; thence leaving Tract 5 and with said right-of-way line N 05? 33′ 02″ E 56.71 feet to a 1/2-inch rebar, set, said rebar being a common corner of Tracts 2 and 3; thence leaving said right-of-way line and with Tract 2 the following five calls: S 15? 05′ 57″ E 221.17 feet to a 1/2-inch rebar, found; with a curve to the left having a radius of 18.42 feet, an arc distance of 45.64 feet, a chord bearing of S 86? 05′ 10″ E and a chord distance of 34.83 feet to a 1/2-inch rebar, found; N 22? 55′ 38″ E 381.36 feet to a 1/2-inch rebar, found; N 54? 30′ 59″ W 54.58 feet to a 1/2-inch rebar, found; N 02? 41′ 04″ W 336.07 feet (passing a larger pine at a distance of 295.17 feet) to the POINT OF BEGINNING and containing 3.36, more or less, as surveyed by Eastern Surveying, Inc., in January, 1999 and shown on a plat made a part of this description. Being the same property conveyed from Gene Lee Tedder to David R. Compton and Rita A. Compton, his wife, by Deed dated January 12, 1999, of record in the aforesaid Clerk’s office in Deed Book No. 803, at page 567. Terms of the sale: cash on date of sale.
