COMPLAINT

Property Location: District 03, Map 17A, Parcel 0086

In response to complaints, the Monongalia County Abandoned and Dilapidated Property Enforcement Agency began an investigation of the property located on Yew Street, Maidsville, Monongalia County, West Virginia. As a result of this investigation, the Agency made the determination that this property is unsafe and a condition exists that is dangerous or detrimental to the public health, safety and/or welfare in violation of WV Code 7-1-3(ff).

To bring this property into compliance with the State Law and the Ordinance as adopted by the Monongalia County Commission on August 4, 1998, amended on June 27, 2001, and amended on July 14, 2004, the owner must complete the Agency recommendations that the dilapidated structure be boarded/secured and/or removed within a sixty-day period. All debris must be removed. All overgrown vegetation should be removed.

Unless the Owner (or other interested party) of the property files with the County Clerk a written request for a hearing within ten (10) days of first publication of this Complaint, an order will be issued by the County Commission accepting the recommendations of the Enforcement Agency. At the end of the 60 day period (February 19, 2016) a fine of $100 per day for every day the work is not complete will be imposed. After the passage of 90 additional days (May 19, 2016) the property will be turned over to the Office of the Prosecuting Attorney for action in Circuit Court. Attempts to deliver previous notices through the US Postal Service were unsuccessful.
