TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated October 8, 2009, and duly recorded in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Book No. 1176, at Page 442, Laura J Billings did convey unto BB&T Collateral Service Corporation, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated October 20, 2015 and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by FV-I, Inc. in Trust for Morgan Stanley Mortgage Capital Holdings LLC to foreclose thereunder, will offer for sale at public auction at the front door of the Mercer County Courthouse in Princeton, West Virginia, on January 7, 2016 at 1:30 PM the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in Beaver Pond District, Mercer County, West Virginia, and more particularly described as follows: All of that certain tract or parcel of real estate designated as Tract A on a Map recorded in the Office of the Clerk of the County Commission of Mercer County, West Virginia as Microfilm Plat Record #12993, and more fully bounded and described as follows: Beginning at a pinched pipe found on the western line of County Route 34, said point being in the southern line of Parcel 11.5, Tax Map 21, thence with the southern line of said roadway the following curves: a Chord bearing S. 41? 40 46″W. a distance of 156.57 feet; a Chord bearing S. 16?28′ 27″ E. 130.00 feet; a Chord bearing S. 56?50′ 14″E. 110.00 feet to an iron bar set; thence S. 30?26′ 12″ W. 207.32 feet to a roof bolt found; thence N. 32?34′ 29″ W. 336.75 feet to a point; thence N. 66?37′ 50″ W. 197.41 feet to a point; thence N. 09?49′ 22″ W. 177.82 feet to a rebar; thence N. 72? 09′ 52″ W. 78.29 feet to a point; thence N. 87?52′ 22′ W. 99.01 feet to a point; thence crossing said County Route 34 and County Route 34/1. N. 05?26′ 58″ W. 282.15 feet to a rebar found; thence S. 61?30′ 50″ E. 766.02 feet to the place of the Beginning and containing 4.82 acres, more or less. There is excepted and reserved from this conveyance that certain out conveyance of a 0.58? acre parcel conveyed to Diana L. Taylor and Teddy D. Taylor, her husband by Deed dated May 16, 2000 from Archie G. Billings and Laura Billings, his wife, said Deed being recorded on September 14, 2000 and is of record in said Clerk’s Office in Deed Book 823, at Page 778. And being the same property conveyed to Archie G. Billings and Laura Billings, his wife by Deed dated October 6, 1997 from David L. Spangler and Janice H. Spangler, his wife, of record in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Deed Book 788, at Page 248. The said Archie G. Billings having died testate on May 9, 2006 and said deed being a survivorship Deed between Grantor and Archie D. Billings, deceased. At the time of the execution of the Deed of Trust, this property was reported to have an address of: 166 Inglevalley Road, Princeton, WV 24740-0000. The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. TERMS: $8,000.00 in cash and/or certified funds as deposit with the balance due and payable within 30 days of the day of sale. FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer. Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
