TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated December 30, 2011, and duly recorded in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Book No. 1224, at Page 629 and re-recorded in Document No. 500985, in Book No. 1248, at Page 169 and re-recorded in Document No. 535412, in Book No. 1264, at Page 441, Chance T. Williams and Brandi Williams did convey unto Richard A. Pill, Esq., Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated November 15, 2012 and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by Wells Fargo Bank, N.A. to foreclose thereunder, will offer for sale at public auction at the front door of the Mercer County Courthouse in Princeton, West Virginia, on January 28, 2016 at 1:30 PM the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in Beaver Pond District, Mercer County, West Virginia, and more particularly described as follows: Those certain tracts of land shown as parcels A and B upon a plat entitled: “Plat of Survey Showing Division of the Melvin H. Bishop Tract as Described in Deed Book 605, at page 737, and is situate at Oakland Terrace in Beaver Pond District, Mercer County, West Virginia, Dana Pettrey & Associates, P.O. Box 641, Athens, West Virginia, Date: 1/26/82 Scale: 1″ =60′ /s/ Dana Pettrey”, and which plat appears of record in the office of the Clerk of the Mercer County Commission as Microplat No. 8113, and which said parcel of real estate is more particularly bounded and described as follows: PARCEL A: “BEGINNING at an iron pin found in the west line of Oakland Drive which marks the northeast corner of Lot 246 of Oakland Terrace: thence S. 77? 56′ 51″ W. 532.42 ft. leaving Oakland Drive and running with the north line of Lot 246 to the east lien of the Harmon School Road; thence N. 18? 02′ 09″ W. 96.67 ft with the east lien of the Harmon School Road to a point; thence N. 17? 51′ 55′ W. 1.66 ft. continuing with the east line of the Harmon School Road to a point; thence N. 77? 56′ 51″ E. 563.55 ft. leaving said Harmon School Road and running through the Melvin Bishop Tract to an iron pin set in the west line of Oakland Drive; thence South 100.00 ft. with Oakland Drive to the BEGINNING and containing 1.23 acres more or less.” PARCEL B: BEGINNING at an iron pin set in the west line of Oakland Drive; thence S. 77? 56′ 51″ W. 563.55 ft. leaving Oakland Drive and running through the Melvin Bishop Tract to the east line of the Harmon School Road; thence N. 17? 51′ 55″ W. 93.75 ft. with the east lien of the Harmon School Road to an iron pin found; thence N. 21? 57′ 45″ W. 4.60 ft. continuing with the east line of the Harmon School Road to a point; thence N. 77? 56′ 51″ E. 594.71 ft, leaving said Harmon School and running through the Melvin Bishop Tract to an iron pin set in the west line of Oakland Drive; thence South 100.00 ft. with Oakland Drive to the BEGINNING and containing 1.30 acres more or less.” At the time of the execution of the Deed of Trust, this property was reported to have an address of: 341 Backwoods Avenue, Princeton, WV 24739. The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. TERMS: $9,000.00 in cash and/or certified funds as deposit with the balance due and payable within 30 days of the day of sale. FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer. Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
