UNITED STATES CURRENCY IN THE AMOUNT OF SIX THOUSAND, THREE HUNDRED AND SEVENTY-ONE DOLLARS AND NO CENTS ($6,671.00); A TITAN TIGER .38 SPECIAL HANDGUN; A TALON 9mm HANDGUN; and A TAURUS .380 HANDGUN (Damien Booker) RESPONDENT CIVIL ACTION NO. 16-C-394-D6 NOTICE OF FILING OF PETITION FOR FORFEITURE The object of this suit is to seek an order forfeiting the herein described property pursuant to the West Virginia Contraband Forfeiture Act, Chapter 60A, Article 7, Section 701 through 707, et. seq., as amended. To: Any claimant of a right or interest in said property You have the right to file a claim to the herein described property on or before the 16th day of February, 2017 at 1:15 p.m. before the Honorable Judge Derek C. Swope. Any such claim must clearly state the identity of the claimant and an address where legal process can be served upon said claimant. The property seized and subject of this suit is described as follows UNITED STATES CURRENCY IN THE AMOUNT OF SIX THOUSAND, THREE HUNDRED AND SEVENTY-ONE DOLLARS AND NO CENTS ($6,671.00); A TITAN TIGER .38 SPECIAL HANDGUN; A TALON 9mm HANDGUN; and A TAURUS .380 HANDGUN. The law enforcement agency responsible for the seizure is the West Virginia Southern Regional Drug and Violent Crime Task Force. The seizure was made on 13th Day of November 2016 during a search of the residence located at 2609 Walters Avenue, Bluefield, WV 24701. That the above listed respondent property was in the possession of Damien Booker. That after the date for filing of said claims, an order of the Court directing forfeiture of the seized property to the State and vesting ownership of said property shall be sought. If you fail to file a claim, thereafter an order, upon proper herein, may be entered against you for the relief demanded in the petition.
