NOTICE OF TRUSTEE SALE OF VALUABLE REAL ESTATE
Pursuant to the authority vested in the undersigned by deed of trust dated the 20th day of March 2015, signed by Richard G. Maxwell, II, to Richard A. Pill, Trustee, which said deed of trust is of record in the Office of the Clerk of the County Commission of Monongalia County, West Virginia, in Trust Deed Book 2051, at page 593, and Golden & Amos, PLLC, Trustee having been requested so to do by the Secured Creditor, and default having been made under the terms and conditions of said deed of trust, and the provisions in said deed of trust concerning acceleration having been complied with by the Secured Creditor and present holder of the note, said Trustee will sell at public auction at 10:45 o’clock a.m. on the
11th day of JULY 2017
at the front doors of the Courthouse in Monongalia County in Morgantown, West Virginia the following described real estate situate in Union District, Monongalia County, West Virginia as follows:
PARCEL ONE: BEGINNING at a point standing within the right of way limits of West Virginia Secondary Route 60 (commonly called Bakers Ridge Road) and standing in the southern line of a parcel conveyed to Modern Medicine, Inc. by deed recorded in Deed Book 1110 at page 16; thence with a new division line, South 30 degrees 18 minutes 10 seconds West (said line passes through a ½" reinforcing rod (set) standing at a distance of 12.49 feet) 215.06 feet in all to a ½" reinforcing rod (set), said rod stands in a line of a parcel conveyed to Donald R. Sr. and Mattie Savage by deed recorded in Deed Book 560 at page 259; thence with said Savage parcel, North 49 degrees 55 minutes 10 seconds West 189.29 feet to a ½" reinforcing rod (set), said rod stands in the eastern line of a parcel conveyed to David A. and Terri K. Travinski by deed recorded in Deed Book 914 at page 397; thence with said Travinski parcel, North 10 degrees 45 minutes 00 seconds East, 61.33 feet to a ½" reinforcing rod (found), said rod marking the common corner to said Travinski parcel and a parcel conveyed to H. Summers and Jacqueline Harrison by deed recorded in Deed Book 1164 at page 516; thence with said Harrison parcel, North 10 degrees 45 minutes 00 seconds East 139.47 feet to a ½" reinforcing rod (set) in a gravel driveway, said rod stands as a corner to a parcel conveyed to Lori R. and Brenda Corbin by deed recorded in Deed Book 929 at page 302; thence with said Corbin parcel and along said Route 60, South 58 degrees 37 minutes 00 seconds East 203.13 feet to a point in the center line of Route 60, said point stands to said Modern Medicine, Inc., parcel; thence with said Modern Medicine, Inc. parcel and Route 60, South 56 degrees 53 minutes 20 seconds East 50.71 feet to the beginning, containing 1.0103 acres, more or less, as shown on a survey prepared by Allan J. Witschi, P.S. No. 587 Greenleaf Surveying Company, Inc. on December 28, 1998, of record in said Clerk’s Office in Deed Book No. 1175, at page 415.
PARCEL TWO: BEGINNING at a point entitled point of beginning "Grosselin Parcel" on a certain plat entitled "Plat of Survey for John Edward Grosselin, III, dated Dec 28, 1998, and revised Jan 7, 2008, by Allan J. Witshi, P.S. N. 587, thence with a line of land now or formerly owned by Barry G. Pallayk, South 56 degrees 53 minutes 20 seconds East 50.00 feet to a point in the right of way of West Virginia State Route 60 (commonly called Bakers Ridge Road); thence leaving said right of way South 30 degrees 18 minutes 10 seconds West 112.49 feet to a point; thence leaving said point North 56 degrees 53 minutes 20 seconds West 50.00 feet to a point in the line of John E. Grosselin, III, 1.0103 acre parcel; thence with the boundary line of said 1.013 acre parcel North 30 degrees 18 minutes 10 seconds East 112.49 feet to the place of beginning and containing 0.129 acres (5,618 square feet).
It is the intention of this notice to sell the secured property by proper description as was intended to be transferred and conveyed in the aforesaid deed of trust.

TERMS OF SALE: Cash in hand on day of sale or within 30 days of date of sale upon terms to be agreed upon between Trustee and successful bidder, time being of the essence; payment for unpaid real estate taxes to be assumed by the purchaser. The Trustee does not warrant title or fitness to this property; it is being purchased as is; this is a buyer beware sale and any buyer is advised to retain counsel before the sale. If there is any part of the process of sale which is found to be objectionable, the Trustee reserves the right to cancel the sale. No purchaser should take possession or make improvements in the premises until the Trustee deed is delivered or recorded. A third party purchaser at sale will be required to pay the purchase price plus all recording and transfer fees.
Trustee at sale is under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.
The party(ies) secured by the Deed of Trust reserve the right to purchase the property at such sale. If the purchaser at sale is unable to complete the terms of purchase within 30 days, the Trustee reserves the right to transfer the property to the next highest bidder.
Any sale hereunder may be adjourned from time to time without any notice other than oral proclamation at the time and place appointed for this sale or by posting of a notice of same. Should the Trustee not appear at the time appointed for the sale and there is no notice posted of a continuance please contact the office of the Trustee to make further inquiry. Any sale may be conducted or adjourned by the designated agent or attorney of the Trustee. The undersigned is fully vested with the authority to sell said property as Trustee by instrument of record.
