NOTICE OF TRUSTEE’S SALE
NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, Pill & Pill, PLLC, by that certain Deed of Trust dated May 19, 2011, executed by the Borrowers, George W. Mike, Jr. and Joyce L. Mike, to Samuel I. White, P.C., the Trustee, of record in the Office of the Clerk of the County Commission of Monongalia County, West Virginia, in Book 1812, at Page 611. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 1032 Bethel Church Rd., Maidsville, WV 26541-8033. Pill & Pill, PLLC was appointed as Substitute Trustee by an APPOINTMENT OF SUCCESSOR TRUSTEE dated November 29, 2016, of record in the Clerk’s Office in Book 2158, at Page 594. The Borrowers defaulted under the Note and Deed of Trust and the Substitute Trustee has been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustee will sell the following described property to the highest bidder at the front door of the Courthouse of Monongalia County, in Morgantown, West Virginia, on the following date:

August 8, 2017 at 5:06 p.m.

The property is described as of that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in Cass District, Monongalia County, West Virginia, and being more particularly described as follows:

All of the following described real estate, which the improvements thereon, situate, lying and being in the Cass District, Monongalia County, West Virginia, and being more particularly bounded and described as follows:

A lot or parcel of land lying and being situate at Route 1, Box 49A, Maidsville, Monongalia County, West Virginia and being known as Parcel 68.1 and part of 68 (the tax parcels are now known as Parcel #68.1 and Parcel #68.3) of The Cass District Tax Map 8 and being more particularly bounded and described as follows:

Beginning at a point, being a corner at the edge of a Right-of-Way to Route 52/1 and parcel 68, the point of beginning; thence with three lines of Parcel 68, South 69° 16′ 10" West, a distance of 305.31 feet to a Cherry tree (found); thence North 19°38′ 50" West, a distance of 214.00 feet to a corner post (found), thence North 59° 08′ 10" East, a distance of 313.26 feet to a corner post (found), being a common corner to Trader & Layman; thence with the line of Trader South 19° 24′ 00" East, a distance of 268.88 feet to the point of beginning, and containing 1.69 acres, as shown on a plat prepared June 22, 1995, by Blue Mountain Engineering, recorded in the Office of the Clerk of the County Commission of Monongalia County, West Virginia, at Deed Book 1111, page 401, incorporated herein for all pertinent purposes and made a part of this description.

There is further granted and conveyed a right of way for purposes of ingress, egress and regress to and from the subject property and Route 52/1, as set forth in that certain Right of Way Agreement dated November 19, 1979, and recorded in said Clerk’s Office at Deed Book 831, page 517.
Being the same real estate that was conveyed unto George William Mike, Jr. and Joyce Lynn Mike, from Timothy W. Marsh and Robin A. Marsh, husband and wife, by deed dated May 17, 2011, and recorded in the Office of the Clerk of the County Commission of Monongalia County, West Virginia in Deed Book 1436, at Page 5.

TERMS OF SALE:
1)The property will be conveyed in an "AS IS" physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.

2)The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code ยง 11-22-1.

3)The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.

4)The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.

5)The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

6)The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of the total purchase price payable to the Trustee at sale.
