NOTICE OF TRUSTEE’S SALE

NOTICE OF TRUSTEE’ S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, Pill & Pill, PLLC, by that certain Deed of Trust dated March 16, 2001, executed by the Borrowers, April M. Shoemaker and Steve R. Shoemaker, to W. Brad Sorrells, the Trustee, of record in the Office of the Clerk of the County Commission of Monongalia County, West Virginia, in Book 1012, at Page 439. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 326 Fern St., Morgantown, WV 26505. Pill & Pill, PLLC was appointed as Substitute Trustee by an APPOINTMENT OF SUCCESSOR TRUSTEE dated June 28, 2017, of record in the Clerk’ s Office in Book 2192, at Page 204. The Borrowers defaulted under the Note and Deed of Trust and the Substitute Trustee has been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Monongalia County, in Morgantown, West Virginia, on the following date:

September 20, 2017 at 5:02 p.m.

All of the following described parcel of real estate together with the improvements thereon and the appurtenances thereunto belonging, situate, lying and being in Grant District, Monongalia County, West Virginia, and more particularly described as follows:

Beginning at a ½” iron pin (found) at the end of Maple Street, corner to David White and John Shoemaker; thence with two lines of John Shoemaker, South 15° 56’ 57” East 46.58 feet to a ½” iron pin (found); thence North 76° 54’ 30” East 151.27 feet to a ½” iron pin (found), corner to John Shoemaker and Gary Sheppard; thence with one line of Sheppard, South 5° 39’ 30” East 123.74 feet to a 1/2” iron pin (found), corner to Gary Sheppard and John Shoemaker; thence, with one line of Shoemaker, South 84° 20’ 30” West 158.32 feet to a ½” iron pin (found), corner to Shoemaker and David White; thence, with one line of White, North 5° 39’ 30” West 150.00 feet to the place of beginning, and containing 0.416 acres, more or less, as shown on a plat prepared by Paul D. Harbert, P.S. No. 862, of McCoy Surveying Company, dated March 2001, which plat is attached hereto and made a part of this description.

There is hereby conveyed a non-exclusive right of way for the purposes of ingress, egress and regress, running across other lands of the Grantors (See Deed Book No. 1135, at page 92) from the subject parcel to Maple Street approximately 20 feet in width having a Western boundary contiguous with lands of David White.

There is hereby EXCEPTED and RESERVED a right of way 20 feet in width running along the Western edge of the subject property and the line adjoining David White (Deed Book 1143, Page 321).

Being the same property conveyed to April M. Shoemaker and Steve R. Shoemaker by the Deed dated March 14, 2001 and recorded in Deed Book 1211, at Page 512, in the Office of the Clerk of the County Commission of Monongalia County, West Virginia.

TERMS OF SALE:

1)The property will be conveyed in an "AS IS" physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.

2)The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code ยง 11-22-1.

3)The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.

4)The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.

5)The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

6)The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of the total purchase price payable to the Trustee at sale.
