YOU ARE HEREBY NOTIFIED THAT: Mountain Valley Pipeline, LLC (“Plaintiff”) has filed a Motion for Summary Judgment (“Motion”) in the United States District Court for the Northern District of West Virginia, Clarksburg Division, located at 500 West Pike Street, Clarksburg, WV 26302. The title of the action is Mountain Valley Pipeline, LLC v. An Easement to Construct and Maintain a 42- Inch Gas Transmission Line et al., Case No. 1:17-cv-00211-TSK.

 

Plaintiff filed the Motion seeking entry of an order of condemnation and an award as to the damages or just compensation owed in connection with the eminent domain action filed pursuant to the federal Natural Gas Act, 15 U.S.C. §§ 717-717z, and Federal Rule of Civil Procedure 71.1. Plaintiff previously filed a complaint in condemnation to acquire certain easements related to the construction, operation, and maintenance of an interstate pipeline, and associated appurtenances necessary for its operation, across properties in the counties of Braxton, Lewis, Harrison, Webster, and Wetzel, West Virginia. A complete copy of the Motion is on file with the Court.

 

If you have any response to the Motion, you are required to file and serve that response with the Court within twenty-one (21) days after being served with this Notice. The Plaintiff’s attorneys are identified below and at the address provided. This Notice is deemed served upon you on the date of the last publication of this Notice.
