Application for a certificate of convenience and necessity

to construct improvements to its water storage and distribution system.

NOTICE OF FILING

On October 4, 2016, Corporation of Shepherdstown (Shepherdstown) filed a duly verified application for a certificate of convenience and necessity to construct improvements to its water storage and distribution system.

The project represents phase two of a three phase capital upgrade to the water system. Phase one was the construction of twin 700,000 gallon elevated storage tanks. Phase three will be an enlargement and modernization of the water treatment plant. Shepherdstown’s new water tanks are fed by an existing 12″ ACP waterline. That line also services several areas between the treatment plant and the tanks. This has led to an inability to fill the tanks in a timely manner to serve users. A new 12″ PVC waterline will be dedicated to filling the tanks. The existing 12″ line will remain in service.

The application is on file with and available for public inspection at the Public Service Commission, 201 Brooks Street, in Charleston, West Virginia.

Shepherdstown estimates that construction will not exceed $2,300,000. It is proposed that the construction will be financed as follows: Shepherdstown ·will issue Revenue Bonds in an amount not to exceed $3,500,000. The proceeds of the Revenue Bonds will be used for all project costs.

Shepherdstown does not seek a rate increase in connection with this project and will continue to charge its existing rates for its customers, pursuant to its current water tariff on file with the Commission. Shepherdstown’s current rates were enacted and became effective July 29, 2016, in accordance with the Public Service Commission’s rules for municipal rate change.

SURCHARGE

The above rates and minimum monthly charges for customers within the corporate limits of Shepherdstown are subject to an additional charge of 4.3478 percent, based upon a local tax of 4 percent computed as follows:

DELAYED PAYMENT PENALTY

The above schedule is net. On all current usage billings not paid in full within twenty (20) days of the billing date, ten percent (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) will be added to the net current amount unpaid. This delayed payment penalty is not interest and is only to be collected once for each bill where it is appropriate.

Available for public fire protection service.

RATE

Twenty-five dollars ($25.00) per fire hydrant, per year­

CONNECTION CHARGE

The fee for new residential water connections will be a $500.00 hook-up fee and a $2,400.00 Capacity Capital Cost Fee for a total of $2,900.00 per new residential water connection; the fee for new commercial water connections will be a $500.00 hook-up fee and a Capacity Capital Cost Fee to be determined by multiplying the residential usage equivalent prescribed by this ordinance by the sum of $2,400.00.

CONNECTION CHARGE

The hookup fee for connections requiring a tap greater than 5/8-inch will have a surcharge added to the standard $500.00 hookup fee, as follows:

RETURNED CHECK CHARGE

Whenever a check is returned for insufficient funds, a service charge of actual cost to the utility (not to exceed $15.00) shall be charged.

SECURITY DEPOSITS

A refundable security deposit of 1/12 the annual estimated charge shall be required prior to service being connected or reconnected. Said deposit will be refunded with interest as stated in the Rules after twelve (12) consecutive months of on time payments.

LEAK ADJUSTMENT INCREMENT

An incremental charge of $0.75 per M gallons shall be charged for all water billed in excess of the customer’s historic usage.

Example Calculation:

A service station with 6 sets of pumps would pay $7,992 per set of pumps or $47,952 total. A set of pumps is one grouping on one side of a gas service island intended to serve 1 vehicle.

Shepherdstown does not have any resale customers.

Anyone desiring to protest or intervene in this Certificate proceeding should file a written protest or notice of intervention within thirty (30) days following the date of this publication unless otherwise modified by Commission order. Failure to timely protest or intervene can affect your right to protest aspects of this certificate case, including any associated rate increases, or to participate in future proceedings. All protests or requests to intervene should briefly state the reason for the protest or intervention. Requests to intervene must comply with the Commission’s rules on intervention set forth in the Commission’s Rules of Practice and Procedure. In the absence of substantial protest received within thirty (30) days of this publication, the Commission may waive formal hearing and render its decision based on the evidence submitted with the application and the Commission’s review thereof.
